       Senator Deutch moved the following:
       
    1         Senate Amendment (with title amendment)
    2  
    3         Between lines 114 and 115
    4  insert:
    5         (8) If attorney’s fees are to be awarded to a claimant’s
    6  attorney under this section, the amount of such fees to be paid
    7  by the employer or carrier may be increased up to the amount of
    8  the fees paid by the employer or carrier to the employer’s or
    9  carrier’s attorneys to defend against the claim if it is
   10  determined that the employer or carrier engaged in a bad faith
   11  denial of benefits, unreasonably delayed furnishing benefits
   12  that were due and owing, or unreasonably continued or increased
   13  the expense of litigation.

   16         And the title is amended as follows:
   17         Delete line 7
   18  and insert:
   19         carrier or employer; providing for parity in
   20         attorney’s fees if the employer or carrier had engaged
   21         in certain conduct; providing an effective date.
