    1                        A bill to be entitled                      
    2         An act relating to mosquito control districts;
    3         creating s. 388.296, F.S.; requiring the board of
    4         commissioners in mosquito control districts containing
    5         Outstanding Florida Waters to consult and coordinate
    6         with the Department of Agriculture and Consumer
    7         Services and water management districts to determine
    8         certain adverse effects and develop mitigation plans
    9         for such adverse effects; specifying dates for the
   10         adoption and implementation of mitigation plans;
   11         authorizing the board to levy taxes for specified
   12         purposes; providing an effective date.

   14  Be It Enacted by the Legislature of the State of Florida:
   15         
   16         Section 1. Section 388.296, Florida Statutes, is created to
   17  read:
   18         388.296Mitigation plans.—The board of commissioners in a
   19  district containing Outstanding Florida Waters shall, in
   20  coordination with the department and the appropriate water
   21  management district, determine if the activities of the district
   22  have had any adverse effects on such waters. If it is determined
   23  that adverse effects have occurred as a result of the district's
   24  activities, the board shall, in consultation with the
   25  appropriate water management district, develop a plan that the
   26  board finds to be technically and economically feasible for the
   27  mitigation of such adverse effects. The mitigation plan shall be
   28  adopted by the district no later than July 1, 2010, and shall be
   29  implemented beginning in the district's 2010-2011 fiscal year.
   30  The board may levy taxes under s. 388.221 for the purposes of
   31  this section.
   32         Section 2. This act shall take effect July 1, 2009.
