The Committee on Finance and Tax (Ring) recommended the
following:
1 Senate Amendment (with title amendment)

3 Delete everything after the enacting clause
4 and insert:
5 Section 1. Section 377.807, Florida Statutes, is created to
6 read:
7 377.807 Energy-efficient appliance rebate program.—The
8 Florida Energy and Climate Commission is authorized to develop
9 and administer a consumer rebate program for residential energy
10 efficient appliances, consistent with 42 U.S.C. s. 15821 and any
11 federal agency guidance or regulations issued in furtherance of
12 federal law. Such appliances may include Energy Star products or
13 electric tankless water heaters that have an energy-efficiency
14 rating of at least 85 percent by the United States Environmental
15 Protection Agency standard calculation, if not otherwise
16 disqualified by the United States Environmental Protection
17 Agency or the United States Department of Energy, as validated
18 by a third-party testing entity, and verified by the commission,
19 pursuant to rule. The commission may adopt rules pursuant to
20 ss.120.536(1) and 120.54 concerning program provisions deemed by
21 federal law to be within the discretion of the commission,
22 consistent with 42 U.S.C. s. 15821 and any subsequent
23 implementing federal regulations or guidance. The commission is
24 authorized to enter into contracts or memoranda of agreement
25 with other agencies of the state, public-private partnerships,
26 or other arrangements such that the most efficient means of
27 administering consumer rebates can be achieved.
28 Section 2. This act shall take effect July 1, 2009.

40 into contracts or memoranda of agreement with other
41 state agencies or partnerships; providing an effective
42 date.
