Floor: 1/AD/2R . 04/29/2009 04:24 PM . ————————————————————————————————————————————————————————————————— ————————————————————————————————————————————————————————————————— Senator Baker moved the following: 1 Senate Amendment (with title amendment) 2 3 Delete lines 20 - 35 4 and insert: 5 federal law. 6 (1) The commission may adopt rules pursuant to ss. 7 120.536(1) and 120.54 designating eligible appliances, rebate 8 amounts, and the administration of the issuance of rebates. The 9 rules shall be consistent with 42 U.S.C. s. 15821 and any 10 subsequent implementing federal regulations or guidance. 11 (2) The commission is authorized to enter into contracts or 12 memoranda of agreement with other agencies of the state, public 13 private partnerships, or other arrangements such that the most 14 efficient means of administering consumer rebates can be 15 achieved. 16 Section 2. For the 2009-2010 fiscal year, the sum of 17 $150,000 is appropriated from the General Revenue Fund to the 18 Florida Energy and Climate Commission for the purpose of 19 administering the energy-efficient appliance rebate program; 20 however, the funds shall not be released to the commission until 21 it has submitted a report to the Legislative Budget Commission 22 certifying that the energy-efficient appliance rebate program 23 complies with 42 U.S.C. s. 15821 and any subsequent implementing 24 federal regulations and that the state will receive funds 25 pursuant to 42 U.S.C. s. 15821 and the American Recovery and 26 Reinvestment Act of 2009 to implement the energy-efficient 27 appliance rebate program. 28 29 ================= T I T L E A M E N D M E N T ================ 30 And the title is amended as follows: 31 Delete lines 5 - 8 32 and insert: 33 and administer a consumer rebate program for specified 34 energy-efficient appliances; authorizing the 35 commission to adopt rules; authorizing the commission 36 to enter into contracts or memoranda of agreement with 37 other agencies of the state, public-private 38 partnerships, and other arrangements for specified 39 purposes; providing an appropriation; providing 40 requirements for the release of the appropriation; 41 providing an effective
