House Comm: FAV . 04/01/2009 . . . . ————————————————————————————————————————————————————————————————— ————————————————————————————————————————————————————————————————— The Committee on Commerce (Sobel) recommended the following: 1 Senate Amendment (with title amendment) 2 3 4 Delete everything after the enacting clause 5 and insert: 6 Section 1. (1) A tax levied under chapter 212, Florida 7 Statutes, may not be collected on the sale of a new energy 8 efficient product having a selling price of $1,500 or less per 9 product from 12:01 a.m., October 1, through midnight, October 10 31. This exemption applies to products purchased for 11 noncommercial home or personal use, and does not apply to 12 products purchased for trade, business, or resale. As used in 13 this section, the term “energy-efficient product” means a 14 dishwasher, clothes washer, air conditioner, ceiling fan, 15 compact fluorescent light bulb, dehumidifier, programmable 16 thermostat, or refrigerator that has been designated by the 17 United States Department of Energy as meeting or exceeding the 18 agency’s requirements for energy efficiency or as meeting or 19 exceeding the requirements under the Energy Star Program. 20 (2) The Department of Revenue may adopt emergency rules to 21 administer this section. 22 Section 2. For the 2009-2010 fiscal year, the sum $73,891 23 is appropriated from the General Revenue Fund to the Department 24 of Revenue to implement and administer the energy-efficient 25 products sales tax holiday created in this act. For the 2010 26 2011 fiscal year a recurring appropriation of $57,028 is 27 appropriated from the General Revenue Fund to the Department of 28 Revenue to administer the energy-efficient products sales tax 29 holiday created in this act. 30 Section 3. This act shall take effect upon becoming a law. 31 32 ================= T I T L E A M E N D M E N T ================ 33 And the title is amended as follows: 34 Delete everything before the enacting clause 35 and insert: 36 A bill to be entitled 37 An act relating to the tax on sales, use, and other 38 transactions; exempting certain energy-efficient 39 products from the tax during the month of October; 40 defining the term “energy-efficient product”; 41 authorizing the Department of Revenue to adopt 42 emergency rules; providing an appropriation; providing 43 an effective date.
