    2         An act relating to insurance; amending s. 624.155,
    3         F.S.; providing a legislative finding with respect to
    4         the fiduciary duty of an insurer; providing an
    5         effective date.

    7  Be It Enacted by the Legislature of the State of Florida:
    8         
    9         Section 1. Subsection (10) is added to section 624.155,
   10  Florida Statutes, to read:
   11         624.155 Civil remedy.—
   12         (10) The Legislature finds and declares that an insurer has
   13  a fiduciary duty to treat those it insures fairly and in good
   14  faith.
   15         Section 2. This act shall take effect July 1, 2009.
