1 A bill to be entitled
2 An act relating to biomedical research; amending ss.
3 215.5602 and 381.922, F.S.; revising the amount of
4 annual appropriations to the Biomedical Research Trust
5 Fund within the Department of Health; requiring that
6 moneys transferred to the trust fund during the 2008
7 2009 fiscal year in excess of specified amounts be
8 transferred to the General Revenue Fund by a specified
9 date; providing an effective date.

11 Be It Enacted by the Legislature of the State of Florida:

13 Section 1. Subsection (12) of section 215.5602, Florida
14 Statutes, is amended to read:
15 215.5602 James and Esther King Biomedical Research
16 Program.—
17 (12) For the 2008-2009 Beginning in fiscal year and each
18 fiscal year thereafter 2006-2007, the sum of $3 $6 million is
19 appropriated annually from recurring funds in the General
20 Revenue Fund to the Biomedical Research Trust Fund within the
21 Department of Health for purposes of the James and Esther King
22 Biomedical Research Program pursuant to this section. From these
23 funds up to $250,000 shall be available for the operating costs
24 of the Florida Center for Universal Research to Eradicate
25 Disease.
26 Section 2. Subsection (5) of section 381.922, Florida
27 Statutes, is amended to read:

29 Cancer Research Program.—
30 (5) For the 2008-2009 Beginning in fiscal year and each
31 fiscal year thereafter 2006-2007, the sum of $4.5 $9 million is
32 appropriated annually from recurring funds in the General
33 Revenue Fund to the Biomedical Research Trust Fund within the
34 Department of Health for purposes of the William G. “Bill”
35 Bankhead, Jr., and David Coley Cancer Research Program and shall
36 be distributed pursuant to this section to provide grants to
37 researchers seeking cures for cancer, with emphasis given to the
38 goals enumerated in s. 381.921. From the total funds
39 appropriated, an amount of up to 10 percent may be used for
40 administrative expenses.
41 Section 3. (1) If, during the 2008-2009 fiscal year, more
42 than $3 million has been transferred from the General Revenue
43 Fund to the Biomedical Research Trust Fund within the Department
44 of Health pursuant to s. 215.5602, Florida Statutes, any amount
45 in excess of $3 million shall be transferred from the Biomedical
46 Research Trust Fund to the General Revenue Fund by March 15,
47 2009.
48 (2) If, during the 2008-2009 fiscal year, more than $4.5
49 million has been transferred from the General Revenue Fund to
50 the Biomedical Research Trust Fund within the Department of
51 Health pursuant to s. 381.922, Florida Statutes, any amount in
52 excess of $4.5 million shall be transferred from the Biomedical
53 Research Trust Fund to the General Revenue Fund by March 15,
54 2009.
55 Section 4. This act shall take effect upon becoming a law.
