    1                        A bill to be entitled                      
    2         An act relating to trust funds; creating the Public
    3         Defenders Revenue Trust Fund within the Justice
    4         Administrative Commission; providing for the purpose
    5         of the trust fund; providing for future review and
    6         termination or re-creation of the trust fund;
    7         providing a contingent effective date.
    8         
    9  Be It Enacted by the Legislature of the State of Florida:
   10         
   11         Section 1. Public Defenders Revenue Trust Fund.—
   12         (1) The Public Defenders Revenue Trust Fund is created
   13  within the Justice Administrative Commission. Moneys credited to
   14  the trust fund shall be used for the purpose of funding the
   15  activities of the public defenders.
   16         (2) In accordance with s. 19(f)(2), Art. III of the State
   17  Constitution, the Public Defenders Revenue Trust Fund shall,
   18  unless terminated sooner, be terminated on July 1, 2012. Before
   19  its scheduled termination, the trust fund shall be reviewed as
   20  provided in s. 215.3206(1) and (2), Florida Statutes.
   21         Section 2. This act shall take effect on the same date as
   22  SB 12-A or similar legislation takes effect, if such legislation
   23  is enacted in the same legislative session, or an extension
   24  thereof, and becomes law, but this act shall not take effect
   25  unless it is enacted by a three-fifths vote of the membership of
   26  each house of the Legislature.
