| 10 | Be It Enacted by the Legislature of the State of Florida: |
| 11 |
|
| 12 | Section 1. (1) The Primary Care Services Trust Fund is |
| 13 | created within the Agency for Health Care Administration. All |
| 14 | proceeds from the cigarette tax distributed pursuant to s. |
| 15 | 210.205(1)(b) and (2)(a), Florida Statutes, shall be deposited |
| 16 | in the trust fund and shall be used for the sole purpose of |
| 17 | distribution to county health department clinics, free clinics, |
| 18 | and federally qualified health centers. |
| 19 | (2) Notwithstanding s. 216.301, Florida Statutes, and |
| 20 | pursuant to s. 216.351, Florida Statutes, any balance in the |
| 21 | trust fund at the end of any fiscal year shall remain in the |
| 22 | trust fund and be available for carrying out the purposes of the |
| 23 | trust fund. |
| 24 | (3) Pursuant to the provisions of s. 19(f)(2), Art. III of |
| 25 | the State Constitution, the trust fund shall, unless terminated |
| 26 | sooner, be terminated on July 1, 2013. Prior to its scheduled |
| 27 | termination, the trust fund shall be reviewed as provided in s. |
| 28 | 215.3206(1) and (2), Florida Statutes. |
| 29 | Section 2. This act shall take effect July 1, 2009, if |
| 30 | House Bill 7A or similar legislation is adopted in the same |
| 31 | legislative session or an extension thereof and becomes a law. |
