A bill to be entitled
2An act relating to the City of Eustis, Lake County;
3authorizing the Division of Alcoholic Beverages and
4Tobacco of the Department of Business and Professional
5Regulation to issue up to a specified number of temporary
6permits to a nonprofit civic organization to sell
7alcoholic beverages for consumption on the premises at
8outdoor events on public right-of-way in the downtown area
9of Eustis; providing that such events require a street-
10closure permit from the City of Eustis; providing that the
11permits authorized by the act are in addition to certain
12other authorized temporary permits; requiring the
13nonprofit civic organization to comply with certain
14statutory requirements in obtaining the permits authorized
15by the act; requiring the division to adopt rules;
16providing an effective date.

18Be It Enacted by the Legislature of the State of Florida:

20     Section 1.  (1)  Notwithstanding any other provision of
21law, the Division of Alcoholic Beverages and Tobacco of the
22Department of Business and Professional Regulation may issue to
23a bona fide nonprofit civic organization, upon application and
24presentation of a valid street-closure permit issued by the City
25of Eustis, a temporary permit authorizing the sale of alcoholic
26beverages for consumption on the premises at outdoor events on
27public right-of-way in the downtown area of Eustis. Any such
28nonprofit civic organization may be issued up to 15 temporary
29permits per calendar year and each temporary permit is valid for
30up to 3 days. For purposes of this act, the downtown area of
31Eustis is described as follows:
32Begin at the Western Right-of-Way of Northshore Drive
33at the intersection of the Northern Right-of-Way of
34Wilt Avenue; thence run East along the Northern Right-
35of-Way of Wilt Avenue to the Eastern Right-of-Way of
36North Grove Street; thence run South along the eastern
37Right-of-Way of North Grove Street (a/k/a SR 19 North)
38to the Northern Right-of-Way of Bates Avenue; thence
39run East along the Norther Right-of-Way Bates Avenue
40to the Eastern Right-of-Way of Dewey Street to the
41Southern Right-of-Way of Citrus Avenue; thence run
42West along the Southern Right-of-Way of Citrus Avenue
43to the Eastern Right-of-Way of North Grove Street
44(a/k/a SR 19 North); thence run South along the
45Eastern Right-of-Way of North Grove Street (a/k/a SR
4619 North) to the Southern Right of Way of Ward Street
47to the Eastern Right-of-Way of West Woodward Avenue;
48thence run West along the Southern Right-of-Way of
49West Woodward Avenue to Lake Eustis; thence run North
50along the waters edge of Lake Eustis and landward to
51the intersection of the Western Right-of-Way of
52Northshore Drive and the Northern Right-of-Way of Wilt
53Avenue and the point of beginning.
54     (2)  The temporary permits authorized by this act are in
55addition to the three temporary permits authorized per year for
56a nonprofit civic organization pursuant to section 561.422,
57Florida Statutes.
58     (3)  The nonprofit civic organization shall comply with all
59other requirements of section 561.422, Florida Statutes, in
60obtaining the temporary permits authorized by this act.
61     (4)  On or before October 1, 2010, the Division of
62Alcoholic Beverages and Tobacco of the Department of Business
63and Professional Regulation shall adopt rules pursuant to
64chapter 120, Florida Statutes, to administer this act. Such
65rules shall include permitting procedures and application forms.
66     Section 2.  This act shall take effect upon becoming a law.
