Florida Senate - 2010 SB 1092 By Senator Ring 32-00456-10 20101092__ 1 A bill to be entitled 2 An act relating to fireworks; repealing s. 10(5) of 3 chapter 2007-67, Laws of Florida, relating to the 4 moratorium on the opening of new, permanent retail 5 sales facilities engaged in the sale of fireworks and 6 the number of permits issued for temporary retail 7 sales facilities engaged in the sale of fireworks; 8 amending s. 791.05, F.S.; requiring a law enforcement 9 officer to seize, take, remove, or cause to be removed 10 at the expense of the owner all stocks of fireworks or 11 combustibles used in violation of ch. 791, F.S., 12 relating to the sale of fireworks; providing an 13 effective date. 14 15 Be It Enacted by the Legislature of the State of Florida: 16 17 Section 1. Subsection (5) of section 10 of chapter 2007-67, 18 Laws of Florida, is repealed. 19 Section 2. Section 791.05, Florida Statutes, is amended to 20 read: 21 791.05 Seizure of illegal fireworks.—Each sheriff, or his 22 or her appointee, or any other police officer, shall seize, 23 take, remove, or cause to be removed, at the expense of the 24 owner, all stocks of fireworks or combustibles offered or 25 exposed for sale, stored, used, or held in violation of this 26 chapter. 27 Section 3. This act shall take effect July 1, 2010.
