1 A bill to be entitled
2 An act relating to school speed zones; creating the
3 “Shaye Patrick Martin Safety Act”; amending s.
4 316.1895, F.S.; providing for transitional speed areas
5 before and after the slowest established speed limit
6 within a school zone; requiring the installation of
7 vehicle speed cameras in school zones to record an
8 image of the driver and the license plate of a motor
9 vehicle exceeding a speed limit within the school
10 zone; providing for such cameras to be included in the
11 Department of Transportation’s uniform system of
12 traffic control devices; providing penalties for
13 violation of a speed limit within a school zone;
14 providing an effective date.

16 Be It Enacted by the Legislature of the State of Florida:
17
18 Section 1. This act may be cited as the “Shaye Patrick
19 Martin Safety Act.”
20 Section 2. Subsections (1), (5), (6), (8), and (10) of
21 section 316.1895, Florida Statutes, are amended to read:
22 316.1895 Establishment of school speed zones;, enforcement;
23 designation.—
24 (1)(a) The Department of Transportation, pursuant to the
25 authority granted under s. 316.0745, shall adopt a uniform
26 system of traffic control devices, including vehicle speed
27 cameras, and pedestrian control devices for use on the streets
28 and highways in the state surrounding all schools, public and
29 private.
30 (b) The Department of Transportation shall compile,
31 publish, and transmit a manual containing all specifications and
32 requirements with respect to the system of devices established
33 pursuant to paragraph (a) to the governing body of each county
34 and municipality in the state, and the Department of
35 Transportation and each county and municipality in the state
36 shall install and maintain such traffic and pedestrian control
37 devices in conformity with such uniform system.
38 (5) A school zone shall include transitional speed areas
39 for a distance of 50 yards before and after the slower posted
40 speed limit. The slower posted speed limit in a school zone may
41 not be less than 15 miles per hour except by local regulation
42 or. No school zone speed limit shall be more than 20 miles per
43 hour in an urbanized area, as defined in s. 334.03. The speed
44 limit in the transitional speed area of a school zone shall be 5
45 miles per hour higher than the slower posted speed limit in the
46 school zone. School zone Such speed limits limit may be in force
47 only during those times 30 minutes before, during, and 30
48 minutes after the periods of time when pupils are arriving at a
49 regularly scheduled breakfast program or a regularly scheduled
50 school session and leaving a regularly scheduled school session.
51 (6) Permanent signs designating school zones and school
52 zone speed limits shall be uniform in size and color, and shall
53 have the times during which the restrictive speed limits are
54 limit is enforced clearly designated thereon. Flashing beacons
55 activated by a time clock, or other automatic device, or
56 manually activated may be used as an alternative to posting the
57 times during which the restrictive school speed limits are limit
58 is enforced. Beginning July 1, 2008, for any newly established
59 school zone or any school zone in which the signing has been
60 replaced, a sign stating “Speeding Fines Doubled” shall be
61 installed within the school zone. The Department of
62 Transportation shall establish adequate standards for the signs
63 and flashing beacons.
64 (8)(a) Nothing in this section herein shall prohibit the
65 use of automatic traffic control devices for the control of
66 vehicular and pedestrian traffic at school crossings.
67 (b) Each school zone shall be equipped with vehicle speed
68 cameras to record images of the driver and the license plate of
69 a motor vehicle exceeding a speed limit within the school zone.
70 Vehicle speed cameras installed in school zones must conform to
71 the specifications adopted by the Department of Transportation
72 pursuant to s. 316.0745.
73 (10) A person may not drive a vehicle on a roadway
74 designated as a school zone at a speed greater than that posted
75 in the school zone in accordance with this section. A violation
76 of a the speed limit limits established pursuant to this section
77 is a noncriminal traffic infraction, punishable must be cited as
78 a moving violation, punishable as provided in chapter 318.
79 Section 3. This act shall take effect July 1, 2010.
