A bill to be entitled
2An act relating to Medicaid postpartum benefits; amending
3s. 409.903, F.S.; providing for continuation of Medicaid
4coverage for women eligible for prenatal care benefits
5under certain circumstances and for a specified period
6postpartum; requiring the Agency for Health Care
7Administration to electronically enroll eligible women;
8authorizing the agency to seek waiver authority; providing
9an effective date.

11Be It Enacted by the Legislature of the State of Florida:

13     Section 1.  Subsection (5) of section 409.903, Florida
14Statutes, is amended to read:
15     409.903  Mandatory payments for eligible persons.-The
16agency shall make payments for medical assistance and related
17services on behalf of the following persons who the department,
18or the Social Security Administration by contract with the
19Department of Children and Family Services, determines to be
20eligible, subject to the income, assets, and categorical
21eligibility tests set forth in federal and state law. Payment on
22behalf of these Medicaid eligible persons is subject to the
23availability of moneys and any limitations established by the
24General Appropriations Act or chapter 216.
25     (5)(a)  A pregnant woman for the duration of her pregnancy
26and for the postpartum period as defined in federal law and
27rule, or a child under age 1, if either is living in a family
28that has an income which is at or below 150 percent of the most
29current federal poverty level, or, effective January 1, 1992,
30that has an income which is at or below 185 percent of the most
31current federal poverty level. Such a person is not subject to
32an assets test. Further, a pregnant woman who applies for
33eligibility for the Medicaid program through a qualified
34Medicaid provider must be offered the opportunity, subject to
35federal rules, to be made presumptively eligible for the
36Medicaid program.
37     (b)  Effective January 1, 2011, a woman who was eligible
38for Medicaid prenatal care benefits during pregnancy and who
39delivered a low birth weight or premature baby or who
40experienced a fetal death in the course of her most recent
41pregnancy. Such a woman is eligible for full Medicaid benefits
42for 2 years postpartum, including primary health care and family
43planning services. The agency shall electronically enroll a
44woman eligible under this paragraph for full Medicaid benefits
45on the date of the delivery of the low birth weight or premature
46baby or on the date of the fetal death. The agency may seek a
47Medicaid state plan amendment or federal waiver approval to
48implement this paragraph.
49     Section 2.  This act shall take effect January 1, 2011.
