A bill to be entitled
2An act relating to City of Tamarac, Broward County;
3extending and enlarging the corporate limits of the City
4of Tamarac to include specified unincorporated lands
5within such corporate limits; providing for an effective
6date of annexation; providing for an interlocal agreement,
7land use and zoning governance, and residency
8qualification for candidacies for municipal office;
9providing applicability to existing contracts; providing
10for transfer of public roads and rights-of-way; providing
11an effective date.

13Be It Enacted by the Legislature of the State of Florida:
14
15     Section 1.  The following described lands shall be annexed
16into and a part of the City of Tamarac effective September 15,
172010:

19Prospect Field Road/West Commercial Boulevard
20Annexation Boundary is described as follows:
21
22A portion of Section 17, Township 49 South, Range 42
23East, Broward County, Florida, more particularly
24described as follows: BEGIN at the point of
25intersection of the North line of the Southeast One-
26Quarter (SE 1/4) of the Northeast One-Quarter(NE 1/4)
27of said Section 17 with the East line of the West One-
28Half (W 1/2) of the Southeast One-Quarter (SE 1/4) of
29the Northeast One-Quarter (NE 1/4) of said Section 17,
30said point being on the municipal boundary of the City
31of  Tamarac, as established by Ordinance  No. 0-81-17
32of the City of Tamarac; Thence along said municipal
33boundary the following 3 courses; Thence Westerly,
34along said North line, to a point 50.00 feet East of
35the West line of the Southeast One-Quarter (SE 1/4) of
36the Northeast One-Quarter (NE 1/4) of said Section 17;
37Thence Southerly, along a line 50.00 feet East of and
38parallel with the West line of the Southeast One-
39Quarter (SE 1/4) of the Northeast One-Quarter (NE 1/4)
40of said section 17, said line being the East right of
41way line of Prospect Field Road, to a point of
42intersection with the South line of the North One-Half
43(N 1/2) of the Northwest One-Quarter (NW 1/4) of the
44Southeast One-Quarter (SE 1/4) of the Northeast One-
45Quarter (NE 1/4) of said Section 17; Thence Easterly,
46along said South line, to the Southeast corner of the
47North One-Half (N 1/2) of the Northwest One-Quarter
48(NW 1/4) of the Southeast One-Quarter (SE 1/4) of the
49Northeast One-Quarter (NE 1/4) of said Section 17,
50said point being on the municipal boundary of the City
51of Fort Lauderdale, as established  by Chapter 71-640,
52Laws of Florida; Thence Northerly, along the East line
53of the Northwest One-Quarter (NW 1/4) of the Southeast
54One-Quarter (SE 1/4) of the Northeast One-Quarter (NE
551/4) of said Section 17,and along said municipal
56boundary to the POINT OF BEGINNING.

58Prospect Field Road/N.W. 31st Avenue Annexation
59Boundary is described as follows:

61A portion of Sections 8 and 17, Township 49 South,
62Range 42 East, Broward County, Florida, described as
63follows: BEGIN at the point of intersection of the
64North right of way line of  Prospect  Field Road with
65a line 264 feet East of and parallel with the West
66line of  said Section 8, said point being on the
67municipal boundary of the City of Fort Lauderdale, as  
68established  by Chapter 71-640, Laws of Florida;
69Thence along said municipal boundary the following 3
70courses; Thence Easterly, along said North right of
71way line, to the North line of said Section 17; Thence
72Easterly, along said North line of Section 17, to the
73West line of Lot 11 of, LITTLE FARMS, according to the
74plat thereof, as recorded in Plat Book 27, Page 29 of
75the Public Records of Broward County, Florida; Thence
76Southerly, along said West line and the Southerly
77prolongation thereof, to the centerline of Orange
78Street as shown on said plat of, LITTLE FARMS, said
79point being on the municipal boundary of the City of
80Fort Lauderdale, as established  by Ordinance No. C-
8187-10 of the City of Fort Lauderdale; Thence
82Southerly, along the West line of Lot 30 of said plat
83and the Northerly prolongation thereof and said
84municipal boundary, to a point on the South line of
85the Northwest One-Quarter (NW 1/4) of the Northwest
86One-Quarter (NW 1/4) of the Northeast One-Quarter (NE
871/4) of said Section 17, said point being on the
88municipal boundary of the City of Tamarac, as
89established by Ordinance No. 0-81-17 of the City of
90Tamarac. Thence along said municipal boundary of the
91City of Tamarac the following 3 courses; Thence
92Westerly, along said South line, to the Southwest
93corner of the Northeast One-Quarter (NE 1/4) of the
94Northeast One-Quarter (NE 1/4) of the Northwest One-
95Quarter (NW 1/4) of said Section 17; Thence Southerly
96to the Southeast corner of the Southwest One-Quarter
97(SW1/4) of the Northeast One-Quarter (NE 1/4) of the
98Northwest One-Quarter (NW 1/4) of said Section 17;
99Thence Westerly to the Southwest corner of the
100Southwest One-Quarter (SW1/4) of the Northeast One-
101Quarter (NE 1/4) of the Northwest One-Quarter (NW 1/4)
102of said Section 17, said point being on the municipal
103boundary of the City of Fort Lauderdale, as
104established by Ordinance No. C-72-22 of the City of
105Fort Lauderdale; Thence along said municipal boundary
106the following 4 courses; Thence Westerly, along the
107South line of the Northwest One-Quarter (NW 1/4) of
108the Northwest One-Quarter (NW 1/4) of said Section 17,
109to the West line of said Section 17; Thence Northerly,
110along said West line, to the South line of the West
111264 feet of  the North One-Half (N 1/2) of the North
112One-Half (N 1/2) of the Northwest One-Quarter (NW 1/4)
113of the Northwest One-Quarter (NW 1/4) of said Section
11417; Thence Easterly, along said South line, to the
115Southeast corner thereof;

117Thence Northerly, along the East line thereof, to the
118POINT OF BEGINNING.
119     Section 2.  An interlocal agreement shall be developed
120between the governing bodies of Broward County and the City of
121Tamarac and executed prior to the effective date of the
122annexation as specified in Section 1. The agreement shall
123address infrastructure improvement projects and include a
124financially feasible plan for transitioning county services,
125buildings, infrastructure, waterways, and employees.
126     Section 3.  Upon annexation into the municipality, the
127areas described in Section 1 shall be governed by the relevant
128land use and zoning provisions of the City of Tamarac's Code of
129Ordinances. Any change of zoning districts or land use
130designations may be accomplished only by enactment of the vote
131of the majority of the full governing body of the municipality
132plus one. Any use, building, or structure that is legally in
133existence at the time of annexation may not be made a prohibited
134use by the City of Tamarac, on the property of such use, for as
135long as the use continues and is not voluntarily abandoned.
136     Section 4.  Any resident in the area to be annexed by this
137act into the City of Tamarac shall be deemed to have met any
138residency requirements for candidacy for municipal office.
139     Section 5.  Nothing in this act may be construed to affect
140or abrogate the rights of parties to any contracts, whether they
141be between Broward County and a third party or between
142nongovernmental entities, which contracts are in effect prior to
143the effective date of the annexation.
144     Section 6.  All public roads, and the public rights-of-way
145associated therewith, in the Broward County Road System, lying
146within the limits of the lands subject to annexation in this act
147as described in Section 1, are transferred from the jurisdiction
148of Broward County to the jurisdiction of the City of Tamarac on
149the effective date of the annexation. All rights, title,
150interests, and responsibilities for any transferred roads,
151including, but not limited to, the ownership, operation,
152maintenance, planning, design, and construction of such roads
153and the rights-of-way associated therewith, shall transfer from
154the jurisdiction and ownership of Broward County to the
155jurisdiction and ownership of the City of Tamarac on the
156effective date of the annexation.
157     Section 7.  This act shall take effect upon becoming a law.
