1 A bill to be entitled
2 An act relating to registration of farm labor
3 contractors and employees; amending s. 450.31, F.S.;
4 requiring the renewal of farm labor contractor and
5 employee certificates of registration under certain
6 circumstances; requiring the Department of Business
7 and Professional Regulation to suspend, revoke, or
8 refuse to issue or renew certificates of registration
9 under certain circumstances; providing an effective
10 date.

12 Be It Enacted by the Legislature of the State of Florida:

14 Section 1. Paragraph (b) of subsection (1) and subsection
15 (2) of section 450.31, Florida Statutes, are amended,
16 subsections (3) through (7) are renumbered as subsections (4)
17 through (8), respectively, and a new subsection (3) is added to
18 that section, to read:
19 450.31 Issuance, revocation, and suspension of, and refusal
20 to issue or renew, certificate of registration.—
21 (1) The department shall not issue to any person a
22 certificate of registration as a farm labor contractor, nor
23 shall it renew such certificate, until:
24 (b) Such person has obtained and holds a valid federal
25 certificate of registration as a farm labor contractor, or a
26 farm labor contractor employee, unless exempt by federal law.
27 However, the department shall renew a certificate of
28 registration after such person’s federal certificate of
29 registration expires if such person files a timely application
30 for renewal with the United States Department of Labor.
31 (2) The department may revoke, suspend, or refuse to issue
32 or renew any certificate of registration when it is shown that
33 the farm labor contractor has:
34 (a) Violated or failed to comply with any provision of this
35 part or the rules adopted pursuant to this part;
36 (b) Made any misrepresentation or false statement in his or
37 her application for a certificate of registration;
38 (c) Given false or misleading information concerning terms,
39 conditions, or existence of employment to persons who are
40 recruited or hired to work on a farm;
41 (d) Been assessed a civil fine by the department for which
42 payment is overdue;
43 (e) Failed to pay unemployment compensation taxes as
44 determined by the Agency for Workforce Innovation; or
45 (f) Been denied, or had suspended or revoked, a federal
46 certificate of registration as a farm labor contractor; or
47 (f)(g) Failed to pay federal employee taxes as determined
48 by the Internal Revenue Service.
49 (3) The department shall suspend, revoke, or refuse to
50 issue or renew a certificate of registration upon the United
51 States Secretary of Labor’s suspension, revocation, or refusal
52 to issue or renew the federal certificate of registration.
53 Section 2. This act shall take effect July 1, 2010.
