    2         An act relating to cost-benefit, return-on-investment,
    3         and dynamic scoring techniques; creating s. 216.138,
    4         F.S.; authorizing the President of the Senate or the
    5         Speaker of the House of Representatives to request
    6         special impact sessions of consensus estimating
    7         conferences to evaluate proposed legislation based on
    8         specified techniques; providing for the information
    9         used in the evaluations to be available to the public
   10         unless otherwise exempt from disclosure; requiring the
   11         Office of Economic and Demographic Research to develop
   12         protocols and procedures to be used by the consensus
   13         estimating conferences when evaluating proposed
   14         legislation; establishing minimum requirements;
   15         requiring submission of a report; requiring the use of
   16         the protocols and procedures until the approval is
   17         affirmatively revoked; amending s. 216.133, F.S.;
   18         conforming a cross-reference to changes made by the
   19         act; providing an effective date.

   21  Be It Enacted by the Legislature of the State of Florida:
   22  
   23         Section 1. Section 216.138, Florida Statutes, is created to
   24  read:
   25         216.138 Authority to request additional analysis of
   26  legislation.—The President of the Senate or the Speaker of the
   27  House of Representatives may request special impact sessions of
   28  consensus estimating conferences to evaluate proposed
   29  legislation based on tools and models not generally employed by
   30  the conferences, including cost-benefit, return-on-investment,
   31  or dynamic scoring techniques, when suitable and appropriate for
   32  the legislation being evaluated. Unless exempt from s.
   33  119.07(1), information used to develop the analyses shall be
   34  available to the public.
   35         Section 2. The Office of Economic and Demographic Research,
   36  acting in consultation with the principals of the consensus
   37  estimating conferences and after receiving public input, shall
   38  develop protocols and procedures necessary to implement the
   39  provisions of s. 216.138, Florida Statutes. At a minimum, the
   40  protocols and procedures to be used for evaluating specific
   41  proposed legislation shall include cost-benefit, return-on
   42  investment, and dynamic scoring techniques, and may include
   43  additional, appropriate economic techniques. Additionally, the
   44  protocols and procedures must address the format for reporting
   45  results and provide proposed linkages to the appropriations and
   46  revenue forecasting processes, including any statutory changes
   47  that may be needed. The linkages must be consistent with the
   48  constitutional requirement for a balanced budget. The office
   49  shall submit a report of its findings and recommendations to the
   50  President of the Senate and the Speaker of the House of
   51  Representatives by December 1, 2010. Subject to approval by the
   52  President of the Senate and the Speaker of the House of
   53  Representatives following the submission of the report, the
   54  protocols and procedures shall be used to the extent feasible
   55  for the analysis of specific proposed legislation by consensus
   56  estimating conferences as provided in s. 216.138, Florida
   57  Statutes, unless and until such approval is subsequently
   58  affirmatively revoked.
   59         Section 3. Section 216.133, Florida Statutes, is amended to
   60  read:
   61         216.133 Definitions; ss. 216.133-216.138 216.133-216.137.
   62  As used in ss. 216.133-216.138 216.133-216.137:
   63         (1) “Consensus estimating conference” includes the Economic
   64  Estimating Conference, the Demographic Estimating Conference,
   65  the Revenue Estimating Conference, the Education Estimating
   66  Conference, the Criminal Justice Estimating Conference, the
   67  Occupational Forecasting Conference, the Early Learning Programs
   68  Estimating Conference, the Self-Insurance Estimating Conference,
   69  the Florida Retirement System Actuarial Assumption Conference,
   70  and the Social Services Estimating Conference.
   71         (2) “Official information” means the data, forecasts,
   72  estimates, analyses, studies, and other information which the
   73  principals of a consensus estimating conference unanimously
   74  adopt for purposes of the state planning and budgeting system.
   75         (3) “Consensus” means the unanimous consent of all of the
   76  principals of a consensus estimating conference.
   77         Section 4. This act shall take effect upon becoming a law.
