A bill to be entitled
2An act relating to Broward County; amending chapter 98-
3521, Laws of Florida, as amended; requiring each member of
4the South Broward Utility Advisory Board appointed by the
5Town of Southwest Ranches to be a water or sewer user
6within the service area of the former South Broward
7Utility; providing an effective date.

9     WHEREAS, in 2008, chapter 98-521, Laws of Florida, was
10amended to provide the Town of Southwest Ranches ("Ranches")
11with two members on the South Broward Utility Advisory Board,
12and
13     WHEREAS, currently, the appointed members are required to
14be both water and sewer users within the South Broward Utility
15service area, and
16     WHEREAS, because most of the properties in the Ranches have
17wells and septic systems, very few properties use both water and
18sewer, and
19     WHEREAS, to increase the potential field of appointed board
20members, the Ranches desires for its appointees to be water or
21sewer users, NOW, THEREFORE,

23Be It Enacted by the Legislature of the State of Florida:

25     Section 1.  Section 1 of chapter 98-521, Laws of Florida,
26as amended by chapter 2008-278, Laws of Florida, is amended to
27read:
28     Section 1.  There is hereby created the South Broward
29Utility Advisory Board, which shall be an advisory board of the
30City of Sunrise. The board shall be composed of seven members,
31as follows: two members shall be appointed by the City of
32Sunrise, two members shall be appointed by the Town of Davie,
33one member shall be appointed by the City of Pembroke Pines, and
34two members shall be appointed by the Town of Southwest Ranches.
35Each member appointed by the Town of Southwest Ranches shall be
36a water or sewer user within the service area of the former
37South Broward Utility. All other Each appointed members member
38shall be a water and sewer users user within the service area of
39the former South Broward Utility. The term Terms of each member
40shall be for 2 years, except that all appointments and retention
41of board members shall be at the sole discretion of the
42appointing authorities.
43     (1)  The responsibility of the board shall be to review and
44advise the City of Sunrise regarding any proposed change by the
45city to the water and sewer rates charged within the area which
46was formerly the South Broward Utility service area. In the
47event of a proposed rate change within such area, the South
48Broward Utility Advisory Board may require the City of Sunrise
49to hire a rate consultant to advise the city regarding such
50proposed rate change.
51     (2)  Within 30 days following notice of a rate change, the
52advisory board shall present a report of its findings to the
53Commission of the City of Sunrise. If presented within the 30-
54day period, the report shall be considered by the commission
55before rates may be altered or changed within the area formerly
56served by the South Broward Utility.
57     (3)  The City of Sunrise shall appropriate not more than
58$25,000 annually for a rate consultant for the South Broward
59Utility Advisory Board, as provided in subsection (1).
60     (4)  The advisory board shall have no legal standing to
61bring any legal action.
62     (5)  The City of Sunrise shall, by ordinance, provide for
63such other procedures and regulations which are not in conflict
64with this act as are necessary for the continued operation of
65the board.
66     Section 2.  This act shall take effect upon becoming a law.
