10 | Be It Enacted by the Legislature of the State of Florida: |
11 |

12 | Section 1. Paragraph (i) is added to subsection (9) of |
13 | section 403.086, Florida Statutes, to read: |
14 | 403.086 Sewage disposal facilities; advanced and secondary |
15 | waste treatment.- |
16 | (9) The Legislature finds that the discharge of domestic |
17 | wastewater through ocean outfalls wastes valuable water supplies |
18 | that should be reclaimed for beneficial purposes to meet public |
19 | and natural systems demands. The Legislature also finds that |
20 | discharge of domestic wastewater through ocean outfalls |
21 | compromises the coastal environment, quality of life, and local |
22 | economies that depend on those resources. The Legislature |
23 | declares that more stringent treatment and management |
24 | requirements for such domestic wastewater and the subsequent, |
25 | timely elimination of ocean outfalls as a primary means of |
26 | domestic wastewater discharge are in the public interest. |
27 | (i) An entity that diverts wastewater flow from a |
28 | receiving facility that discharges domestic wastewater through |
29 | an ocean outfall is required to meet the 60-percent reuse |
30 | requirement of paragraph (c). Reuse of any such flows by the |
31 | diverting entity shall be credited to the diverting entity, the |
32 | diverted flow shall also be correspondingly deducted from the |
33 | receiving facility's actual flow on an annual basis, as |
34 | calculated pursuant to paragraph (c), and the receiving |
35 | facility's reuse requirement shall be recalculated accordingly. |
36 | Section 2. This act shall take effect July 1, 2010. |
