A bill to be entitled
2An act relating to sewage disposal facilities; amending s.
3403.086, F.S.; requiring entities that divert wastewater
4flows from facilities discharging wastewater through ocean
5outfalls to meet specified reuse requirements; providing
6for the recalculation of specified reuse requirements for
7facilities from which such flows are diverted; providing
8an effective date.

10Be It Enacted by the Legislature of the State of Florida:

12     Section 1.  Paragraph (i) is added to subsection (9) of
13section 403.086, Florida Statutes, to read:
14     403.086  Sewage disposal facilities; advanced and secondary
15waste treatment.-
16     (9)  The Legislature finds that the discharge of domestic
17wastewater through ocean outfalls wastes valuable water supplies
18that should be reclaimed for beneficial purposes to meet public
19and natural systems demands. The Legislature also finds that
20discharge of domestic wastewater through ocean outfalls
21compromises the coastal environment, quality of life, and local
22economies that depend on those resources. The Legislature
23declares that more stringent treatment and management
24requirements for such domestic wastewater and the subsequent,
25timely elimination of ocean outfalls as a primary means of
26domestic wastewater discharge are in the public interest.
27     (i)  An entity that diverts wastewater flow from a
28receiving facility that discharges domestic wastewater through
29an ocean outfall is required to meet the 60-percent reuse
30requirement of paragraph (c). Reuse of any such flows by the
31diverting entity shall be credited to the diverting entity, the
32diverted flow shall also be correspondingly deducted from the
33receiving facility's actual flow on an annual basis, as
34calculated pursuant to paragraph (c), and the receiving
35facility's reuse requirement shall be recalculated accordingly.
36     Section 2.  This act shall take effect July 1, 2010.
