A bill to be entitled
2An act relating to public K-12 education; providing a
3short title; amending s. 1007.35, F.S.; providing
4reporting requirements for the Florida Partnership for
5Minority and Underrepresented Student Achievement relating
6to Advanced Placement instruction; amending s. 1011.62,
7F.S., relating to funds for the operation of schools;
8revising requirements for the allocation of funds
9appropriated for International Baccalaureate, Advanced
10International Certificate of Education, and Advanced
11Placement instruction and corresponding teacher bonuses;
12removing limitations on teacher bonuses; providing an
13effective date.

15     WHEREAS, the State of Florida is constitutionally mandated
16to provide for a high-quality system of public education, and
17     WHEREAS, studies have shown that having high-quality
18teachers is one of the most important contributors to high
19levels of student achievement, and
20     WHEREAS, Florida should do whatever possible to recruit,
21retain, and reward teachers for excellence in education while
22operating within its budgetary constraints, and
23     WHEREAS, Florida must continue to recognize its highest-
24achieving teachers based on student performance, and
25     WHEREAS, Advanced Placement Examination results for Florida
26students demonstrated that minority students in the 2009
27graduating senior class showed improvement over previous years
28in both the percentage of students taking and the percentage of
29students passing Advanced Placement Examinations, and
30     WHEREAS, a stream of revenue currently exists for the
31purpose of rewarding excellent teachers of Advanced Placement,
32International Baccalaureate, and Advanced International
33Certificate of Education courses, and
34     WHEREAS, such revenue should be spent more effectively,
35with a larger portion of the revenue used for bonuses for
36deserving teachers rather than for administrative overhead
37costs, NOW, THEREFORE,

39Be It Enacted by the Legislature of the State of Florida:
40
41     Section 1.  This act may be cited as the "Incentives for
42Excellence in Education Act."
43     Section 2.  Paragraph (l) is added to subsection (6) of
44section 1007.35, Florida Statutes, to read:
45     1007.35  Florida Partnership for Minority and
46Underrepresented Student Achievement.-
47     (6)  The partnership shall:
48     (l)  In conjunction with the Department of Education, post
49an annual report on the department's website on or before August
501 each year that delineates:
51     1.  The total number of teachers who participate in
52professional development associated with Advanced Placement
53courses; the registration fees associated with such professional
54development; and the number and value of scholarships awarded by
55the College Board for teacher participation in Advanced
56Placement professional development.
57     2.  The number of students who enroll in Advanced Placement
58courses; the number of Advanced Placement courses in which such
59students enroll; the number and percentage of students enrolled
60in Advanced Placement courses who take the Advanced Placement
61Examination that corresponds to each course; the number and
62percentage of students enrolled in Advanced Placement courses
63who take the Advanced Placement Examination that corresponds to
64each course and receive a score of 3 or higher; and the number
65and percentage of students who take an Advanced Placement
66Examination without having enrolled in the corresponding
67Advanced Placement course and earn a score of 3 or higher. Such
68information shall be reported by subject, race, and gender.
69     3.  The amount paid by the state for each examination and
70the total rebates provided to each school for the administration
71of Advanced Placement Examinations.
72     Section 3.  Paragraphs (m), (n), and (o) of subsection (1)
73of section 1011.62, Florida Statutes, are amended to read:
74     1011.62  Funds for operation of schools.-If the annual
75allocation from the Florida Education Finance Program to each
76district for operation of schools is not determined in the
77annual appropriations act or the substantive bill implementing
78the annual appropriations act, it shall be determined as
79follows:
80     (1)  COMPUTATION OF THE BASIC AMOUNT TO BE INCLUDED FOR
81OPERATION.-The following procedure shall be followed in
82determining the annual allocation to each district for
83operation:
84     (m)  Calculation of additional full-time equivalent
85membership based on International Baccalaureate examination
86scores of students.-A value of 0.16 full-time equivalent student
87membership shall be calculated for each student enrolled in an
88International Baccalaureate course who receives a score of 4 or
89higher on a subject examination. A value of 0.3 full-time
90equivalent student membership shall be calculated for each
91student who receives an International Baccalaureate diploma.
92Such value shall be added to the total full-time equivalent
93student membership in basic programs for grades 9 through 12 in
94the subsequent fiscal year. Each school district must allocate
95100 percent of the funds received for International
96Baccalaureate instruction to the program that generates such
97funds. Funds allocated in accordance with this paragraph shall
98be expended solely for the payment of administrative costs
99associated with the International Baccalaureate Program and
100teacher bonuses. Administrative costs include costs associated
101with International Baccalaureate annual school fees and
102examination fees and professional development for International
103Baccalaureate teachers. The teacher bonus shall equal the
104proportionate value of the 0.16 additional funding minus
105administrative costs for each eligible student score, or $50 per
106eligible student score, whichever is greater. The teacher bonus
107in a school designated with a grade of "D" or "F" shall equal 10
108times the proportionate value of the 0.16 additional funding
109minus administrative costs for each eligible student score and
110minus the fees charged for each examination, or $500 per
111eligible student score, whichever is greater. The school
112district shall distribute to each classroom teacher who provided
113international baccalaureate instruction:
114     1.  A bonus in the amount of $50 for each student taught by
115the International Baccalaureate teacher in each international
116baccalaureate course who receives a score of 4 or higher on the
117international baccalaureate examination.
118     2.  An additional bonus of $500 to each International
119Baccalaureate teacher in a school designated with a grade of "D"
120or "F" who has at least one student scoring 4 or higher on the
121international baccalaureate examination, regardless of the
122number of classes taught or of the number of students scoring a
1234 or higher on the international baccalaureate examination.

125Bonuses awarded to a teacher according to this paragraph shall
126not exceed $2,000 in any given school year and shall be in
127addition to any regular wage or other bonus the teacher received
128or is scheduled to receive.
129     (n)  Calculation of additional full-time equivalent
130membership based on Advanced International Certificate of
131Education examination scores of students.-A value of 0.16 full-
132time equivalent student membership shall be calculated for each
133student enrolled in a full-credit Advanced International
134Certificate of Education course who receives a score of E or
135higher on a subject examination. A value of 0.08 full-time
136equivalent student membership shall be calculated for each
137student enrolled in a half-credit Advanced International
138Certificate of Education course who receives a score of E or
139higher on a subject examination. A value of 0.3 full-time
140equivalent student membership shall be calculated for each
141student who receives an Advanced International Certificate of
142Education diploma. Such value shall be added to the total full-
143time equivalent student membership in basic programs for grades
1449 through 12 in the subsequent fiscal year. Each school district
145must allocate 100 percent of the funds received for Advanced
146International Certificate of Education instruction to the
147program that generates such funds. Funds allocated in accordance
148with this paragraph shall be expended solely for the payment of
149administrative costs associated with the Advanced International
150Certificate of Education Program and teacher bonuses.
151Administrative costs include costs associated with Advanced
152International Certificate of Education annual school fees and
153examination fees and professional development for Advanced
154International Certificate of Education teachers. The teacher
155bonus shall equal the proportionate value of the 0.16 or 0.08
156additional funding minus administrative costs for each eligible
157student score, or $50 per eligible student score, whichever is
158greater. The teacher bonus in a school designated with a grade
159of "D" or "F" shall equal 10 times the proportionate value of
160the 0.16 or 0.08 additional funding minus administrative costs
161for each eligible student score and minus the fees charged for
162each examination, or $500 per eligible student score, whichever
163is greater. The school district shall distribute to each
164classroom teacher who provided Advanced International
165Certificate of Education instruction:
166     1.  A bonus in the amount of $50 for each student taught by
167the Advanced International Certificate of Education teacher in
168each full-credit Advanced International Certificate of Education
169course who receives a score of E or higher on the Advanced
170International Certificate of Education examination. A bonus in
171the amount of $25 for each student taught by the Advanced
172International Certificate of Education teacher in each half-
173credit Advanced International Certificate of Education course
174who receives a score of E or higher on the Advanced
175International Certificate of Education examination.
176     2.  An additional bonus of $500 to each Advanced
177International Certificate of Education teacher in a school
178designated with a grade of "D" or "F" who has at least one
179student scoring E or higher on the full-credit Advanced
180International Certificate of Education examination, regardless
181of the number of classes taught or of the number of students
182scoring an E or higher on the full-credit Advanced International
183Certificate of Education examination.
184     3.  Additional bonuses of $250 each to teachers of half-
185credit Advanced International Certificate of Education classes
186in a school designated with a grade of "D" or "F" which has at
187least one student scoring an E or higher on the half-credit
188Advanced International Certificate of Education examination in
189that class. The maximum additional bonus for a teacher awarded
190in accordance with this subparagraph shall not exceed $500 in
191any given school year. Teachers receiving an award under
192subparagraph 2. are not eligible for a bonus under this
193subparagraph.

195Bonuses awarded to a teacher according to this paragraph shall
196not exceed $2,000 in any given school year and shall be in
197addition to any regular wage or other bonus the teacher received
198or is scheduled to receive.
199     (o)  Calculation of additional full-time equivalent
200membership based on College Board Advanced Placement scores of
201students.-A value of 0.16 full-time equivalent student
202membership shall be calculated for each student in each Advanced
203Placement course who receives a score of 3 or higher on the
204College Board Advanced Placement Examination for the prior year
205and added to the total full-time equivalent student membership
206in basic programs for grades 9 through 12 in the subsequent
207fiscal year. Each school district must allocate 100 percent of
208the funds received for Advanced Placement instruction to the
209school that generates such funds. Funds allocated in accordance
210with this paragraph shall be expended solely for the payment of
211administrative costs associated with the Advanced Placement
212Program and teacher bonuses. Administrative costs include costs
213associated with Advanced Placement Examination fees and
214professional development for Advanced Placement teachers. The
215teacher bonus shall equal the proportionate value of the 0.16
216additional funding minus administrative costs for each eligible
217student score, or $50 per eligible student score, whichever is
218greater. The teacher bonus in a school designated with a grade
219of "D" or "F" shall equal 10 times the proportionate value of
220the 0.16 additional funding minus administrative costs for each
221eligible student score and minus the fees charged for each
222examination, or $500 per eligible student score, whichever is
223greater. Each district must allocate at least 80 percent of the
224funds provided to the district for advanced placement
225instruction, in accordance with this paragraph, to the high
226school that generates the funds. The school district shall
227distribute to each classroom teacher who provided advanced
228placement instruction:
229     1.  A bonus in the amount of $50 for each student taught by
230the Advanced Placement teacher in each advanced placement course
231who receives a score of 3 or higher on the College Board
232Advanced Placement Examination.
233     2.  An additional bonus of $500 to each Advanced Placement
234teacher in a school designated with a grade of "D" or "F" who
235has at least one student scoring 3 or higher on the College
236Board Advanced Placement Examination, regardless of the number
237of classes taught or of the number of students scoring a 3 or
238higher on the College Board Advanced Placement Examination.

240Bonuses awarded to a teacher according to this paragraph shall
241not exceed $2,000 in any given school year and shall be in
242addition to any regular wage or other bonus the teacher received
243or is scheduled to receive.
244     Section 4.  This act shall take effect July 1, 2010.
