11 | Placement instruction and corresponding teacher bonuses; |
12 | removing limitations on teacher bonuses; providing an |
13 | effective date. |

15 | WHEREAS, the State of Florida is constitutionally mandated |
16 | to provide for a high-quality system of public education, and |
17 | WHEREAS, studies have shown that having high-quality |
18 | teachers is one of the most important contributors to high |
19 | levels of student achievement, and |
20 | WHEREAS, Florida should do whatever possible to recruit, |
21 | retain, and reward teachers for excellence in education while |
22 | operating within its budgetary constraints, and |
23 | WHEREAS, Florida must continue to recognize its highest- |
24 | achieving teachers based on student performance, and |
25 | WHEREAS, Advanced Placement Examination results for Florida |
26 | students demonstrated that minority students in the 2009 |
27 | graduating senior class showed improvement over previous years |
28 | in both the percentage of students taking and the percentage of |
29 | students passing Advanced Placement Examinations, and |
30 | WHEREAS, a stream of revenue currently exists for the |
31 | purpose of rewarding excellent teachers of Advanced Placement, |
32 | International Baccalaureate, and Advanced International |
33 | Certificate of Education courses, and |
34 | WHEREAS, such revenue should be spent more effectively, |
35 | with a larger portion of the revenue used for bonuses for |
36 | deserving teachers rather than for administrative overhead |
37 | costs, NOW, THEREFORE, |

39 | Be It Enacted by the Legislature of the State of Florida: |
40 |
|
41 | Section 1. This act may be cited as the "Incentives for |
42 | Excellence in Education Act." |
43 | Section 2. Paragraph (l) is added to subsection (6) of |
44 | section 1007.35, Florida Statutes, to read: |
45 | 1007.35 Florida Partnership for Minority and |
46 | Underrepresented Student Achievement.- |
47 | (6) The partnership shall: |
48 | (l) In conjunction with the Department of Education, post |
49 | an annual report on the department's website on or before August |
50 | 1 each year that delineates: |
51 | 1. The total number of teachers who participate in |
52 | professional development associated with Advanced Placement |
53 | courses; the registration fees associated with such professional |
54 | development; and the number and value of scholarships awarded by |
55 | the College Board for teacher participation in Advanced |
56 | Placement professional development. |
57 | 2. The number of students who enroll in Advanced Placement |
58 | courses; the number of Advanced Placement courses in which such |
59 | students enroll; the number and percentage of students enrolled |
60 | in Advanced Placement courses who take the Advanced Placement |
61 | Examination that corresponds to each course; the number and |
62 | percentage of students enrolled in Advanced Placement courses |
63 | who take the Advanced Placement Examination that corresponds to |
64 | each course and receive a score of 3 or higher; and the number |
65 | and percentage of students who take an Advanced Placement |
66 | Examination without having enrolled in the corresponding |
67 | Advanced Placement course and earn a score of 3 or higher. Such |
68 | information shall be reported by subject, race, and gender. |
69 | 3. The amount paid by the state for each examination and |
70 | the total rebates provided to each school for the administration |
71 | of Advanced Placement Examinations. |
72 | Section 3. Paragraphs (m), (n), and (o) of subsection (1) |
73 | of section 1011.62, Florida Statutes, are amended to read: |
74 | 1011.62 Funds for operation of schools.-If the annual |
75 | allocation from the Florida Education Finance Program to each |
76 | district for operation of schools is not determined in the |
77 | annual appropriations act or the substantive bill implementing |
78 | the annual appropriations act, it shall be determined as |
79 | follows: |
80 | (1) COMPUTATION OF THE BASIC AMOUNT TO BE INCLUDED FOR |
81 | OPERATION.-The following procedure shall be followed in |
82 | determining the annual allocation to each district for |
83 | operation: |
84 | (m) Calculation of additional full-time equivalent |
85 | membership based on International Baccalaureate examination |
86 | scores of students.-A value of 0.16 full-time equivalent student |
87 | membership shall be calculated for each student enrolled in an |
88 | International Baccalaureate course who receives a score of 4 or |
89 | higher on a subject examination. A value of 0.3 full-time |
90 | equivalent student membership shall be calculated for each |
91 | student who receives an International Baccalaureate diploma. |
92 | Such value shall be added to the total full-time equivalent |
93 | student membership in basic programs for grades 9 through 12 in |
94 | the subsequent fiscal year. Each school district must allocate |
95 | 100 percent of the funds received for International |
96 | Baccalaureate instruction to the program that generates such |
97 | funds. Funds allocated in accordance with this paragraph shall |
98 | be expended solely for the payment of administrative costs |
99 | associated with the International Baccalaureate Program and |
100 | teacher bonuses. Administrative costs include costs associated |
101 | with International Baccalaureate annual school fees and |
102 | examination fees and professional development for International |
103 | Baccalaureate teachers. The teacher bonus shall equal the |
104 | proportionate value of the 0.16 additional funding minus |
105 | administrative costs for each eligible student score, or $50 per |
106 | eligible student score, whichever is greater. The teacher bonus |
107 | in a school designated with a grade of "D" or "F" shall equal 10 |
108 | times the proportionate value of the 0.16 additional funding |
109 | minus administrative costs for each eligible student score and |
110 | minus the fees charged for each examination, or $500 per |
111 | eligible student score, whichever is greater. The school |
112 | district shall distribute to each classroom teacher who provided |
113 | international baccalaureate instruction: |
114 | 1. A bonus in the amount of $50 for each student taught by |
115 | the International Baccalaureate teacher in each international |
116 | baccalaureate course who receives a score of 4 or higher on the |
117 | international baccalaureate examination. |
118 | 2. An additional bonus of $500 to each International |
119 | Baccalaureate teacher in a school designated with a grade of "D" |
120 | or "F" who has at least one student scoring 4 or higher on the |
121 | international baccalaureate examination, regardless of the |
122 | number of classes taught or of the number of students scoring a |
123 | 4 or higher on the international baccalaureate examination. |

125 | Bonuses awarded to a teacher according to this paragraph shall |
126 | not exceed $2,000 in any given school year and shall be in |
127 | addition to any regular wage or other bonus the teacher received |
128 | or is scheduled to receive. |
129 | (n) Calculation of additional full-time equivalent |
130 | membership based on Advanced International Certificate of |
131 | Education examination scores of students.-A value of 0.16 full- |
132 | time equivalent student membership shall be calculated for each |
133 | student enrolled in a full-credit Advanced International |
134 | Certificate of Education course who receives a score of E or |
135 | higher on a subject examination. A value of 0.08 full-time |
136 | equivalent student membership shall be calculated for each |
137 | student enrolled in a half-credit Advanced International |
138 | Certificate of Education course who receives a score of E or |
139 | higher on a subject examination. A value of 0.3 full-time |
140 | equivalent student membership shall be calculated for each |
141 | student who receives an Advanced International Certificate of |
142 | Education diploma. Such value shall be added to the total full- |
143 | time equivalent student membership in basic programs for grades |
144 | 9 through 12 in the subsequent fiscal year. Each school district |
145 | must allocate 100 percent of the funds received for Advanced |
146 | International Certificate of Education instruction to the |
147 | program that generates such funds. Funds allocated in accordance |
148 | with this paragraph shall be expended solely for the payment of |
149 | administrative costs associated with the Advanced International |
150 | Certificate of Education Program and teacher bonuses. |
151 | Administrative costs include costs associated with Advanced |
152 | International Certificate of Education annual school fees and |
153 | examination fees and professional development for Advanced |
154 | International Certificate of Education teachers. The teacher |
155 | bonus shall equal the proportionate value of the 0.16 or 0.08 |
156 | additional funding minus administrative costs for each eligible |
157 | student score, or $50 per eligible student score, whichever is |
158 | greater. The teacher bonus in a school designated with a grade |
159 | of "D" or "F" shall equal 10 times the proportionate value of |
160 | the 0.16 or 0.08 additional funding minus administrative costs |
161 | for each eligible student score and minus the fees charged for |
162 | each examination, or $500 per eligible student score, whichever |
163 | is greater. The school district shall distribute to each |
164 | classroom teacher who provided Advanced International |
165 | Certificate of Education instruction: |
166 | 1. A bonus in the amount of $50 for each student taught by |
167 | the Advanced International Certificate of Education teacher in |
168 | each full-credit Advanced International Certificate of Education |
169 | course who receives a score of E or higher on the Advanced |
170 | International Certificate of Education examination. A bonus in |
171 | the amount of $25 for each student taught by the Advanced |
172 | International Certificate of Education teacher in each half- |
173 | credit Advanced International Certificate of Education course |
174 | who receives a score of E or higher on the Advanced |
175 | International Certificate of Education examination. |
176 | 2. An additional bonus of $500 to each Advanced |
177 | International Certificate of Education teacher in a school |
178 | designated with a grade of "D" or "F" who has at least one |
179 | student scoring E or higher on the full-credit Advanced |
180 | International Certificate of Education examination, regardless |
181 | of the number of classes taught or of the number of students |
182 | scoring an E or higher on the full-credit Advanced International |
183 | Certificate of Education examination. |
184 | 3. Additional bonuses of $250 each to teachers of half- |
185 | credit Advanced International Certificate of Education classes |
186 | in a school designated with a grade of "D" or "F" which has at |
187 | least one student scoring an E or higher on the half-credit |
188 | Advanced International Certificate of Education examination in |
189 | that class. The maximum additional bonus for a teacher awarded |
190 | in accordance with this subparagraph shall not exceed $500 in |
191 | any given school year. Teachers receiving an award under |
192 | subparagraph 2. are not eligible for a bonus under this |
193 | subparagraph. |

195 | Bonuses awarded to a teacher according to this paragraph shall |
196 | not exceed $2,000 in any given school year and shall be in |
197 | addition to any regular wage or other bonus the teacher received |
198 | or is scheduled to receive. |
199 | (o) Calculation of additional full-time equivalent |
200 | membership based on College Board Advanced Placement scores of |
201 | students.-A value of 0.16 full-time equivalent student |
202 | membership shall be calculated for each student in each Advanced |
203 | Placement course who receives a score of 3 or higher on the |
204 | College Board Advanced Placement Examination for the prior year |
205 | and added to the total full-time equivalent student membership |
206 | in basic programs for grades 9 through 12 in the subsequent |
207 | fiscal year. Each school district must allocate 100 percent of |
208 | the funds received for Advanced Placement instruction to the |
209 | school that generates such funds. Funds allocated in accordance |
210 | with this paragraph shall be expended solely for the payment of |
211 | administrative costs associated with the Advanced Placement |
212 | Program and teacher bonuses. Administrative costs include costs |
213 | associated with Advanced Placement Examination fees and |
214 | professional development for Advanced Placement teachers. The |
215 | teacher bonus shall equal the proportionate value of the 0.16 |
216 | additional funding minus administrative costs for each eligible |
217 | student score, or $50 per eligible student score, whichever is |
218 | greater. The teacher bonus in a school designated with a grade |
219 | of "D" or "F" shall equal 10 times the proportionate value of |
220 | the 0.16 additional funding minus administrative costs for each |
221 | eligible student score and minus the fees charged for each |
222 | examination, or $500 per eligible student score, whichever is |
223 | greater. Each district must allocate at least 80 percent of the |
224 | funds provided to the district for advanced placement |
225 | instruction, in accordance with this paragraph, to the high |
226 | school that generates the funds. The school district shall |
227 | distribute to each classroom teacher who provided advanced |
228 | placement instruction: |
229 | 1. A bonus in the amount of $50 for each student taught by |
230 | the Advanced Placement teacher in each advanced placement course |
231 | who receives a score of 3 or higher on the College Board |
232 | Advanced Placement Examination. |
233 | 2. An additional bonus of $500 to each Advanced Placement |
234 | teacher in a school designated with a grade of "D" or "F" who |
235 | has at least one student scoring 3 or higher on the College |
236 | Board Advanced Placement Examination, regardless of the number |
237 | of classes taught or of the number of students scoring a 3 or |
238 | higher on the College Board Advanced Placement Examination. |

240 | Bonuses awarded to a teacher according to this paragraph shall |
241 | not exceed $2,000 in any given school year and shall be in |
242 | addition to any regular wage or other bonus the teacher received |
243 | or is scheduled to receive. |
244 | Section 4. This act shall take effect July 1, 2010. |
