11 | Placement instruction and corresponding teacher bonuses; |
12 | removing certain limitations on teacher bonuses; |
13 | authorizing school districts to prorate teacher bonuses |
14 | under certain circumstances; providing an effective date. |

16 | Be It Enacted by the Legislature of the State of Florida: |
17 |
|
18 | Section 1. This act may be cited as the "Incentives for |
19 | Excellence in Education Act." |
20 | Section 2. Paragraph (l) is added to subsection (6) of |
21 | section 1007.35, Florida Statutes, to read: |
22 | 1007.35 Florida Partnership for Minority and |
23 | Underrepresented Student Achievement.- |
24 | (6) The partnership shall: |
25 | (l) In conjunction with the Department of Education, post |
26 | an annual report on the department's website on or before |
27 | January 15 each year that delineates: |
28 | 1. The total number of teachers who participate in |
29 | professional development associated with Advanced Placement |
30 | courses; the registration fees associated with such professional |
31 | development; and the number and value of scholarships awarded by |
32 | the College Board for teacher participation in Advanced |
33 | Placement professional development. |
34 | 2. The number of students per school who enroll in |
35 | Advanced Placement courses; the number of Advanced Placement |
36 | courses in which such students enroll; the number and percentage |
37 | of students enrolled in Advanced Placement courses who take the |
38 | Advanced Placement Examination that corresponds to each course; |
39 | the number and percentage of students enrolled in Advanced |
40 | Placement courses who take the Advanced Placement Examination |
41 | that corresponds to each course and receive a score of 3 or |
42 | higher; and the number and percentage of students who take an |
43 | Advanced Placement Examination without having enrolled in the |
44 | corresponding Advanced Placement course and earn a score of 3 or |
45 | higher. Such information shall be reported at the state level by |
46 | subject, race, and gender. |
47 | 3. The amount paid by the state for each examination and |
48 | the total rebates provided to each school for the administration |
49 | of Advanced Placement Examinations. |
50 | Section 3. Paragraphs (m), (n), and (o) of subsection (1) |
51 | of section 1011.62, Florida Statutes, are amended to read: |
52 | 1011.62 Funds for operation of schools.-If the annual |
53 | allocation from the Florida Education Finance Program to each |
54 | district for operation of schools is not determined in the |
55 | annual appropriations act or the substantive bill implementing |
56 | the annual appropriations act, it shall be determined as |
57 | follows: |
58 | (1) COMPUTATION OF THE BASIC AMOUNT TO BE INCLUDED FOR |
59 | OPERATION.-The following procedure shall be followed in |
60 | determining the annual allocation to each district for |
61 | operation: |
62 | (m) Calculation of additional full-time equivalent |
63 | membership based on International Baccalaureate examination |
64 | scores of students.-A value of 0.16 full-time equivalent student |
65 | membership shall be calculated for each student enrolled in an |
66 | International Baccalaureate course who receives a score of 4 or |
67 | higher on a subject examination. A value of 0.3 full-time |
68 | equivalent student membership shall be calculated for each |
69 | student who receives an International Baccalaureate diploma. |
70 | Such value shall be added to the total full-time equivalent |
71 | student membership in basic programs for grades 9 through 12 in |
72 | the subsequent fiscal year. Each school district must allocate |
73 | 100 percent of the funds received for International |
74 | Baccalaureate instruction to the program that generates such |
75 | funds. Funds allocated in accordance with this paragraph shall |
76 | be expended solely for the payment of administrative costs |
77 | associated with the International Baccalaureate Program and |
78 | teacher bonuses. Administrative costs shall include costs |
79 | associated with International Baccalaureate annual school fees |
80 | and examination fees and professional development for |
81 | International Baccalaureate teachers. The teacher bonus shall |
82 | equal the proportionate value of the 0.16 additional funding per |
83 | eligible student score minus administrative costs, or $50 per |
84 | eligible student score, whichever is greater. The teacher bonus |
85 | in a school designated with a grade of "D" or "F" shall be an |
86 | additional $500 if any of the teacher's International |
87 | Baccalaureate students scores 4 or higher on an International |
88 | Baccalaureate examination. The school district shall distribute |
89 | to each classroom teacher who provided international |
90 | baccalaureate instruction: |
91 | 1. A bonus in the amount of $50 for each student taught by |
92 | the International Baccalaureate teacher in each international |
93 | baccalaureate course who receives a score of 4 or higher on the |
94 | international baccalaureate examination. |
95 | 2. An additional bonus of $500 to each International |
96 | Baccalaureate teacher in a school designated with a grade of "D" |
97 | or "F" who has at least one student scoring 4 or higher on the |
98 | international baccalaureate examination, regardless of the |
99 | number of classes taught or of the number of students scoring a |
100 | 4 or higher on the international baccalaureate examination. |

102 | Bonuses awarded to a teacher according to this paragraph shall |
103 | not exceed $2,000 in any given school year and shall be in |
104 | addition to any regular wage or other bonus the teacher received |
105 | or is scheduled to receive. If funds received pursuant to this |
106 | paragraph are not sufficient to fully pay for teacher bonuses, a |
107 | school district may prorate all teacher bonuses proportionately |
108 | to the total funds available. |
109 | (n) Calculation of additional full-time equivalent |
110 | membership based on Advanced International Certificate of |
111 | Education examination scores of students.-A value of 0.16 full- |
112 | time equivalent student membership shall be calculated for each |
113 | student enrolled in a full-credit Advanced International |
114 | Certificate of Education course who receives a score of E or |
115 | higher on a subject examination. A value of 0.08 full-time |
116 | equivalent student membership shall be calculated for each |
117 | student enrolled in a half-credit Advanced International |
118 | Certificate of Education course who receives a score of E or |
119 | higher on a subject examination. A value of 0.3 full-time |
120 | equivalent student membership shall be calculated for each |
121 | student who receives an Advanced International Certificate of |
122 | Education diploma. Such value shall be added to the total full- |
123 | time equivalent student membership in basic programs for grades |
124 | 9 through 12 in the subsequent fiscal year. Each school district |
125 | must allocate 100 percent of the funds received for Advanced |
126 | International Certificate of Education instruction to the |
127 | program that generates such funds. Funds allocated in accordance |
128 | with this paragraph shall be expended solely for the payment of |
129 | administrative costs associated with the Advanced International |
130 | Certificate of Education Program and teacher bonuses. |
131 | Administrative costs shall include costs associated with |
132 | Advanced International Certificate of Education annual school |
133 | fees and examination fees and professional development for |
134 | Advanced International Certificate of Education teachers. The |
135 | teacher bonus shall equal the proportionate value of the 0.16 or |
136 | 0.08 additional funding per eligible student score minus |
137 | administrative costs, or $50 per eligible student score, |
138 | whichever is greater. The teacher bonus in a school designated |
139 | with a grade of "D" or "F" shall be an additional $500 if any of |
140 | the teacher's Advanced International Certificate of Education |
141 | students scores E or higher on an Advanced International |
142 | Certificate of Education examination. The school district shall |
143 | distribute to each classroom teacher who provided Advanced |
144 | International Certificate of Education instruction: |
145 | 1. A bonus in the amount of $50 for each student taught by |
146 | the Advanced International Certificate of Education teacher in |
147 | each full-credit Advanced International Certificate of Education |
148 | course who receives a score of E or higher on the Advanced |
149 | International Certificate of Education examination. A bonus in |
150 | the amount of $25 for each student taught by the Advanced |
151 | International Certificate of Education teacher in each half- |
152 | credit Advanced International Certificate of Education course |
153 | who receives a score of E or higher on the Advanced |
154 | International Certificate of Education examination. |
155 | 2. An additional bonus of $500 to each Advanced |
156 | International Certificate of Education teacher in a school |
157 | designated with a grade of "D" or "F" who has at least one |
158 | student scoring E or higher on the full-credit Advanced |
159 | International Certificate of Education examination, regardless |
160 | of the number of classes taught or of the number of students |
161 | scoring an E or higher on the full-credit Advanced International |
162 | Certificate of Education examination. |
163 | 3. Additional bonuses of $250 each to teachers of half- |
164 | credit Advanced International Certificate of Education classes |
165 | in a school designated with a grade of "D" or "F" which has at |
166 | least one student scoring an E or higher on the half-credit |
167 | Advanced International Certificate of Education examination in |
168 | that class. The maximum additional bonus for a teacher awarded |
169 | in accordance with this subparagraph shall not exceed $500 in |
170 | any given school year. Teachers receiving an award under |
171 | subparagraph 2. are not eligible for a bonus under this |
172 | subparagraph. |

174 | Bonuses awarded to a teacher according to this paragraph shall |
175 | not exceed $2,000 in any given school year and shall be in |
176 | addition to any regular wage or other bonus the teacher received |
177 | or is scheduled to receive. If funds received pursuant to this |
178 | paragraph are not sufficient to fully pay for teacher bonuses, a |
179 | school district may prorate all teacher bonuses proportionately |
180 | to the total funds available. |
181 | (o) Calculation of additional full-time equivalent |
182 | membership based on College Board Advanced Placement scores of |
183 | students.-A value of 0.16 full-time equivalent student |
184 | membership shall be calculated for each student in each Advanced |
185 | Placement course who receives a score of 3 or higher on the |
186 | College Board Advanced Placement Examination for the prior year |
187 | and added to the total full-time equivalent student membership |
188 | in basic programs for grades 9 through 12 in the subsequent |
189 | fiscal year. Each school district must allocate 100 percent of |
190 | the funds received for Advanced Placement instruction to the |
191 | school that generates such funds. Funds allocated in accordance |
192 | with this paragraph shall be expended solely for the payment of |
193 | administrative costs associated with the Advanced Placement |
194 | Program and teacher bonuses. Administrative costs shall include |
195 | costs associated with Advanced Placement Examination fees and |
196 | professional development for Advanced Placement teachers. The |
197 | teacher bonus shall equal the proportionate value of the 0.16 |
198 | additional funding per eligible student score minus |
199 | administrative costs, or $50 per eligible student score, |
200 | whichever is greater. The teacher bonus in a school designated |
201 | with a grade of "D" or "F" shall include an additional $500 per |
202 | student for the teacher's first four students who score 3 or |
203 | higher on an Advanced Placement Examination. Each district must |
204 | allocate at least 80 percent of the funds provided to the |
205 | district for advanced placement instruction, in accordance with |
206 | this paragraph, to the high school that generates the funds. The |
207 | school district shall distribute to each classroom teacher who |
208 | provided advanced placement instruction: |
209 | 1. A bonus in the amount of $50 for each student taught by |
210 | the Advanced Placement teacher in each advanced placement course |
211 | who receives a score of 3 or higher on the College Board |
212 | Advanced Placement Examination. |
213 | 2. An additional bonus of $500 to each Advanced Placement |
214 | teacher in a school designated with a grade of "D" or "F" who |
215 | has at least one student scoring 3 or higher on the College |
216 | Board Advanced Placement Examination, regardless of the number |
217 | of classes taught or of the number of students scoring a 3 or |
218 | higher on the College Board Advanced Placement Examination. |

220 | Bonuses awarded to a teacher according to this paragraph shall |
221 | not exceed $2,000 in any given school year and shall be in |
222 | addition to any regular wage or other bonus the teacher received |
223 | or is scheduled to receive. If funds received pursuant to this |
224 | paragraph are not sufficient to fully pay for teacher bonuses, a |
225 | school district may prorate all teacher bonuses proportionately |
226 | to the total funds available. |
227 | Section 4. This act shall take effect July 1, 2010. |
