A bill to be entitled
2An act relating to public K-12 education; providing a
3short title; amending s. 1007.35, F.S.; providing
4reporting requirements for the Florida Partnership for
5Minority and Underrepresented Student Achievement relating
6to Advanced Placement instruction; amending s. 1011.62,
7F.S., relating to funds for the operation of schools;
8revising requirements for the allocation of funds
9appropriated for International Baccalaureate, Advanced
10International Certificate of Education, and Advanced
11Placement instruction and corresponding teacher bonuses;
12removing certain limitations on teacher bonuses;
13authorizing school districts to prorate teacher bonuses
14under certain circumstances; providing an effective date.

16Be It Enacted by the Legislature of the State of Florida:
17
18     Section 1.  This act may be cited as the "Incentives for
19Excellence in Education Act."
20     Section 2.  Paragraph (l) is added to subsection (6) of
21section 1007.35, Florida Statutes, to read:
22     1007.35  Florida Partnership for Minority and
23Underrepresented Student Achievement.-
24     (6)  The partnership shall:
25     (l)  In conjunction with the Department of Education, post
26an annual report on the department's website on or before
27January 15 each year that delineates:
28     1.  The total number of teachers who participate in
29professional development associated with Advanced Placement
30courses; the registration fees associated with such professional
31development; and the number and value of scholarships awarded by
32the College Board for teacher participation in Advanced
33Placement professional development.
34     2.  The number of students per school who enroll in
35Advanced Placement courses; the number of Advanced Placement
36courses in which such students enroll; the number and percentage
37of students enrolled in Advanced Placement courses who take the
38Advanced Placement Examination that corresponds to each course;
39the number and percentage of students enrolled in Advanced
40Placement courses who take the Advanced Placement Examination
41that corresponds to each course and receive a score of 3 or
42higher; and the number and percentage of students who take an
43Advanced Placement Examination without having enrolled in the
44corresponding Advanced Placement course and earn a score of 3 or
45higher. Such information shall be reported at the state level by
46subject, race, and gender.
47     3.  The amount paid by the state for each examination and
48the total rebates provided to each school for the administration
49of Advanced Placement Examinations.
50     Section 3.  Paragraphs (m), (n), and (o) of subsection (1)
51of section 1011.62, Florida Statutes, are amended to read:
52     1011.62  Funds for operation of schools.-If the annual
53allocation from the Florida Education Finance Program to each
54district for operation of schools is not determined in the
55annual appropriations act or the substantive bill implementing
56the annual appropriations act, it shall be determined as
57follows:
58     (1)  COMPUTATION OF THE BASIC AMOUNT TO BE INCLUDED FOR
59OPERATION.-The following procedure shall be followed in
60determining the annual allocation to each district for
61operation:
62     (m)  Calculation of additional full-time equivalent
63membership based on International Baccalaureate examination
64scores of students.-A value of 0.16 full-time equivalent student
65membership shall be calculated for each student enrolled in an
66International Baccalaureate course who receives a score of 4 or
67higher on a subject examination. A value of 0.3 full-time
68equivalent student membership shall be calculated for each
69student who receives an International Baccalaureate diploma.
70Such value shall be added to the total full-time equivalent
71student membership in basic programs for grades 9 through 12 in
72the subsequent fiscal year. Each school district must allocate
73100 percent of the funds received for International
74Baccalaureate instruction to the program that generates such
75funds. Funds allocated in accordance with this paragraph shall
76be expended solely for the payment of administrative costs
77associated with the International Baccalaureate Program and
78teacher bonuses. Administrative costs shall include costs
79associated with International Baccalaureate annual school fees
80and examination fees and professional development for
81International Baccalaureate teachers. The teacher bonus shall
82equal the proportionate value of the 0.16 additional funding per
83eligible student score minus administrative costs, or $50 per
84eligible student score, whichever is greater. The teacher bonus
85in a school designated with a grade of "D" or "F" shall be an
86additional $500 if any of the teacher's International
87Baccalaureate students scores 4 or higher on an International
88Baccalaureate examination. The school district shall distribute
89to each classroom teacher who provided international
90baccalaureate instruction:
91     1.  A bonus in the amount of $50 for each student taught by
92the International Baccalaureate teacher in each international
93baccalaureate course who receives a score of 4 or higher on the
94international baccalaureate examination.
95     2.  An additional bonus of $500 to each International
96Baccalaureate teacher in a school designated with a grade of "D"
97or "F" who has at least one student scoring 4 or higher on the
98international baccalaureate examination, regardless of the
99number of classes taught or of the number of students scoring a
1004 or higher on the international baccalaureate examination.

102Bonuses awarded to a teacher according to this paragraph shall
103not exceed $2,000 in any given school year and shall be in
104addition to any regular wage or other bonus the teacher received
105or is scheduled to receive. If funds received pursuant to this
106paragraph are not sufficient to fully pay for teacher bonuses, a
107school district may prorate all teacher bonuses proportionately
108to the total funds available.
109     (n)  Calculation of additional full-time equivalent
110membership based on Advanced International Certificate of
111Education examination scores of students.-A value of 0.16 full-
112time equivalent student membership shall be calculated for each
113student enrolled in a full-credit Advanced International
114Certificate of Education course who receives a score of E or
115higher on a subject examination. A value of 0.08 full-time
116equivalent student membership shall be calculated for each
117student enrolled in a half-credit Advanced International
118Certificate of Education course who receives a score of E or
119higher on a subject examination. A value of 0.3 full-time
120equivalent student membership shall be calculated for each
121student who receives an Advanced International Certificate of
122Education diploma. Such value shall be added to the total full-
123time equivalent student membership in basic programs for grades
1249 through 12 in the subsequent fiscal year. Each school district
125must allocate 100 percent of the funds received for Advanced
126International Certificate of Education instruction to the
127program that generates such funds. Funds allocated in accordance
128with this paragraph shall be expended solely for the payment of
129administrative costs associated with the Advanced International
130Certificate of Education Program and teacher bonuses.
131Administrative costs shall include costs associated with
132Advanced International Certificate of Education annual school
133fees and examination fees and professional development for
134Advanced International Certificate of Education teachers. The
135teacher bonus shall equal the proportionate value of the 0.16 or
1360.08 additional funding per eligible student score minus
137administrative costs, or $50 per eligible student score,
138whichever is greater. The teacher bonus in a school designated
139with a grade of "D" or "F" shall be an additional $500 if any of
140the teacher's Advanced International Certificate of Education
141students scores E or higher on an Advanced International
142Certificate of Education examination. The school district shall
143distribute to each classroom teacher who provided Advanced
144International Certificate of Education instruction:
145     1.  A bonus in the amount of $50 for each student taught by
146the Advanced International Certificate of Education teacher in
147each full-credit Advanced International Certificate of Education
148course who receives a score of E or higher on the Advanced
149International Certificate of Education examination. A bonus in
150the amount of $25 for each student taught by the Advanced
151International Certificate of Education teacher in each half-
152credit Advanced International Certificate of Education course
153who receives a score of E or higher on the Advanced
154International Certificate of Education examination.
155     2.  An additional bonus of $500 to each Advanced
156International Certificate of Education teacher in a school
157designated with a grade of "D" or "F" who has at least one
158student scoring E or higher on the full-credit Advanced
159International Certificate of Education examination, regardless
160of the number of classes taught or of the number of students
161scoring an E or higher on the full-credit Advanced International
162Certificate of Education examination.
163     3.  Additional bonuses of $250 each to teachers of half-
164credit Advanced International Certificate of Education classes
165in a school designated with a grade of "D" or "F" which has at
166least one student scoring an E or higher on the half-credit
167Advanced International Certificate of Education examination in
168that class. The maximum additional bonus for a teacher awarded
169in accordance with this subparagraph shall not exceed $500 in
170any given school year. Teachers receiving an award under
171subparagraph 2. are not eligible for a bonus under this
172subparagraph.

174Bonuses awarded to a teacher according to this paragraph shall
175not exceed $2,000 in any given school year and shall be in
176addition to any regular wage or other bonus the teacher received
177or is scheduled to receive. If funds received pursuant to this
178paragraph are not sufficient to fully pay for teacher bonuses, a
179school district may prorate all teacher bonuses proportionately
180to the total funds available.
181     (o)  Calculation of additional full-time equivalent
182membership based on College Board Advanced Placement scores of
183students.-A value of 0.16 full-time equivalent student
184membership shall be calculated for each student in each Advanced
185Placement course who receives a score of 3 or higher on the
186College Board Advanced Placement Examination for the prior year
187and added to the total full-time equivalent student membership
188in basic programs for grades 9 through 12 in the subsequent
189fiscal year. Each school district must allocate 100 percent of
190the funds received for Advanced Placement instruction to the
191school that generates such funds. Funds allocated in accordance
192with this paragraph shall be expended solely for the payment of
193administrative costs associated with the Advanced Placement
194Program and teacher bonuses. Administrative costs shall include
195costs associated with Advanced Placement Examination fees and
196professional development for Advanced Placement teachers. The
197teacher bonus shall equal the proportionate value of the 0.16
198additional funding per eligible student score minus
199administrative costs, or $50 per eligible student score,
200whichever is greater. The teacher bonus in a school designated
201with a grade of "D" or "F" shall include an additional $500 per
202student for the teacher's first four students who score 3 or
203higher on an Advanced Placement Examination. Each district must
204allocate at least 80 percent of the funds provided to the
205district for advanced placement instruction, in accordance with
206this paragraph, to the high school that generates the funds. The
207school district shall distribute to each classroom teacher who
208provided advanced placement instruction:
209     1.  A bonus in the amount of $50 for each student taught by
210the Advanced Placement teacher in each advanced placement course
211who receives a score of 3 or higher on the College Board
212Advanced Placement Examination.
213     2.  An additional bonus of $500 to each Advanced Placement
214teacher in a school designated with a grade of "D" or "F" who
215has at least one student scoring 3 or higher on the College
216Board Advanced Placement Examination, regardless of the number
217of classes taught or of the number of students scoring a 3 or
218higher on the College Board Advanced Placement Examination.

220Bonuses awarded to a teacher according to this paragraph shall
221not exceed $2,000 in any given school year and shall be in
222addition to any regular wage or other bonus the teacher received
223or is scheduled to receive. If funds received pursuant to this
224paragraph are not sufficient to fully pay for teacher bonuses, a
225school district may prorate all teacher bonuses proportionately
226to the total funds available.
227     Section 4.  This act shall take effect July 1, 2010.
