A bill to be entitled
2An act relating to aquatic preserves; amending s. 258.39,
3F.S.; revising provisions relating to the boundaries of
4aquatic preserves; declaring described state-owned
5submerged lands in specified counties as aquatic
6preserves; creating the Nature Coast Aquatic Preserve;
7describing the boundaries thereof; clarifying an exemption
8from such dedication for certain lands; providing an
9effective date.

11Be It Enacted by the Legislature of the State of Florida:
12
13     Section 1.  Section 258.39, Florida Statutes, is amended to
14read:
15     258.39  Boundaries of preserves.-The state-owned submerged
16lands included within the boundaries of Bay, Brevard, Charlotte,
17Citrus, Collier, Duval, Escambia, Flagler, Franklin, Gulf,
18Hernando, Indian River, Lake, Lee, Leon, Marion, Martin, Miami-
19Dade, Monroe, Nassau, Okaloosa, Orange, Palm Beach, Pasco,
20Pinellas, St. Johns, St. Lucie, Santa Rosa, Seminole, and
21Volusia Nassau, Duval, St. Johns, Flagler, Volusia, Brevard,
22Indian River, St. Lucie, Charlotte, Pinellas, Martin, Palm
23Beach, Miami-Dade, Monroe, Collier, Lee, Citrus, Franklin, Gulf,
24Bay, Okaloosa, Marion, Santa Rosa, Hernando, and Escambia
25Counties, as hereinafter described, with the exception of
26privately held submerged lands lying landward of established
27bulkheads and of privately held submerged lands within Monroe
28County where the establishment of bulkhead lines is not
29required, are hereby declared to be aquatic preserves. Such
30aquatic preserve areas include:
31     (1)  The Fort Clinch State Park Aquatic Preserve, as
32described in the Official Records of Nassau County in Book 108,
33pages 343-346, and in Book 111, page 409.
34     (2)  Nassau River-St. Johns River Marshes Aquatic Preserve,
35as described in the Official Records of Duval County in Volume
363183, pages 547-552, and in the Official Records of Nassau
37County in Book 108, pages 232-237.
38     (3)  Pellicer Creek Aquatic Preserve, as described in the
39Official Records of St. Johns County in Book 181, pages 363-366,
40and in the Official Records of Flagler County in Book 33, pages
41131-134.
42     (4)  Tomoka Marsh Aquatic Preserve, as described in the
43Official Records of Flagler County in Book 33, pages 135-138,
44and in the Official Records of Volusia County in Book 1244,
45pages 615-618.
46     (5)  Mosquito Lagoon Aquatic Preserve, as described in the

75excluding those lands contained within the corporate boundary of
76the City of Vero Beach as of the effective date of this act:
77Commence at the intersection of the north line of Section 31,
78Township 28 South, Range 38 East, and the westerly mean high
79water line of Indian River for a point of beginning; thence from
80the said point of beginning proceed northerly, westerly, and
81easterly along the mean high water line of Indian River and its
82navigable tributaries to an intersection with the north line of

84easterly, to a point on the easterly mean high water line of

114     (b)  For purposes of the Indian River-Malabar to Vero Beach
115Aquatic Preserve, a lease of sovereign submerged lands for a
116noncommercial dock may be deemed to be in the public interest
117when the noncommercial dock constitutes a reasonable exercise of
118riparian rights and is consistent with the preservation of the
119exceptional biological, aesthetic, or scientific values which
120the aquatic preserve was created to protect.
121     (8)  Indian River-Vero Beach to Fort Pierce Aquatic
122Preserve, as described in the Official Records of Indian River
123County in Book 368, pages 9-12, and in the Official Records of
124St. Lucie County in Book 187, pages 1083-1086. More
125specifically, within that description, the southern corporate
126line of Vero Beach refers to the southerly corporate boundary
127line of Vero Beach as it existed on June 3, 1970, which is also
128a westerly projection of the south boundary of "Indian Bay"
129subdivision as recorded in Plat Book 3, page 43, Docket No.
13059267, Public Records of Indian River County, and State Road A1A
131refers to State Road A1A, North Beach Causeway, located north of
132Fort Pierce Inlet.
133     (9)  Jensen Beach to Jupiter Inlet Aquatic Preserve, as
134described in the Official Records of St. Lucie County in Book
135218, pages 2865-2869. More specifically, within that
136description, the southerly corporate line of the City of Fort
137Pierce refers to the southerly corporate boundary line of the
138City of Fort Pierce as it existed in 1969; and the western
139boundary of the preserve as it crosses the St. Lucie River is

331     (30)  Wekiva River Aquatic Preserve, the boundaries of
332which are generally: All the state-owned sovereignty lands lying
333waterward of the ordinary high-water mark of the Wekiva River
334and the Little Wekiva River and their tributaries lying and
335being in Lake, Seminole, and Orange counties and more
336particularly described as follows:
337     (a)  In Sections 15, 16, 17, 20, 21, 22, 27, 28, 29, and
33830, Township 20 South, Range 29 East. These sections are also
339depicted on the Forest City Quadrangle (U.S.G.S. 7.5 minute
340series-topographic) 1959 (70PR); and
341     (b)  In Sections 3, 4, 8, 9, and 10, Township 20 South,
342Range 29 East and in Sections 21, 28, and 33, Township 19 South,
343Range 29 East lying north of the right-of-way for the Atlantic
344Coast Line Railroad and that part of Section 33, Township 19
345South, Range 29 East lying between the Lake and Orange County
346lines and the right-of-way of the Atlantic Coast Line Railroad.
347These sections are also depicted on the Sanford SW Quadrangle
348(U.S.G.S. 7.5 minute series-topographic) 1965 (70-1); and
349     (c)  All state-owned sovereignty lands, public lands, and
350lands whether public or private below the ordinary high-water

353below the 10 foot m.s.l. contour line nearest the meander line
354of the Wekiva River and all state-owned sovereignty lands,
355public lands, and lands whether public or private below the
356ordinary high-water mark of the Wekiva River and the Little
357Wekiva and their tributaries within the Moses E. Levy Grant in
358Lake County below the 10 foot m.s.l. contour line nearest the
359meander lines of the Wekiva River and Black Water Creek as
360depicted on the PINE LAKES 1962 (70-1), ORANGE CITY 1964 (70PR),
361SANFORD 1965 (70-1), and SANFORD S.W. 1965 (70-1) QUADRANGLES

363     (d)  All state-owned sovereignty lands, public lands, and

368the ORANGE CITY 1964 (70PR), SANFORD 1965 (70-1), and SANFORD
369S.W. 1965 (70-1) QUADRANGLES (U.S.G.S. 7.5 minute topographic)
370within the following described property: Beginning at a point on
371the south boundary of the Moses E. Levy Grant, Township 19
372South, Range 29 East, at its intersection with the meander line
373of the Wekiva River; thence south 60 1/2 degrees east along said
374boundary line 4,915.68 feet; thence north 29 1/2 degrees east
37515,516.5 feet to the meander line of the St. Johns River; thence
376northerly along the meander line of the St. Johns River to the

391     3.  That part of the east  1/4 of the SW  1/4 of Section

414     (31)  Rookery Bay Aquatic Preserve, the boundaries of which
415are generally: All of the state-owned sovereignty lands lying
416waterward of the mean high-water line in Rookery Bay and in
417Henderson Creek and the tributaries thereto in Collier County,
418Florida. Said lands are more particularly described as lying and
419being in Sections 27, 34, 35, and 36, Township 50 South, Range
42025 East; in Section 31, Township 50 South, Range 26 East; in
421Sections 1, 2, 3, 10, 11, 12, 13, 14, 23, 24, and 25, Township
42251 South, Range 25 East; and in Sections 5, 6, 7, 8, 9, 10, 15,
42316, 17, 18, 19, 20, 30, and 31, Township 51 South, Range 26
424East, Collier County, Florida, and all the sovereignty submerged
425lands lying within the following described boundaries: Begin at
426the southwest corner of Section 30, Township 52 South, Range 27
427East, Collier County: Thence proceed easterly along the
428southerly line of said Section 30 to the southwest corner of
429Section 29, Township 52 South, Range 27 East; proceed thence
430northerly along the westerly lines of Sections 29, 20 and 17 to
