10 | Be It Enacted by the Legislature of the State of Florida: |
11 |

12 | Section 1. Subsection (7) of section 366.91, Florida |
13 | Statutes, is amended to read: |
14 | 366.91 Renewable energy.- |
15 | (7) Under the provisions of subsections (5) and (6), when |
16 | a utility purchases power generated from biogas produced by the |
17 | anaerobic digestion of agricultural waste, including food waste |
18 | or other agricultural byproducts, net metering shall be |
19 | available at a single metering point or as a part of conjunctive |
20 | billing of multiple points for a customer at a single location, |
21 | so long as the provision of such service and its associated |
22 | charges, terms, and other conditions are not reasonably |
23 | projected to result in higher cost electric service to the |
24 | utility's general body of ratepayers or adversely affect the |
25 | adequacy or reliability of electric service to all customers, as |
26 | determined by the commission for public utilities, or as |
27 | determined by the governing authority of the municipal electric |
28 | utility or rural electric cooperative that serves at retail. |
29 | Section 2. Pursuant to s. 366.92(3), Florida Statutes, the |
30 | Legislature ratifies chapters 25-17.400, 25-17.410, and 25- |
31 | 17.420, Florida Administrative Code, approved on January 9, |
32 | 2009, by the Public Service Commission. |
33 | Section 3. This act shall take effect upon becoming a law. |
