8 | Be It Enacted by the Legislature of the State of Florida: |

10 | Section 1. Paragraph (a) of subsection (4) of section |
11 | 394.9082, Florida Statutes, is amended to read: |
12 | 394.9082 Behavioral health managing entities.- |
13 | (4) CONTRACT FOR SERVICES.- |
14 | (a) The department may contract for the purchase and |
15 | management of behavioral health services with community-based |
16 | managing entities. The department may require a managing entity |
17 | to contract for specialized services that are not currently part |
18 | of the managing entity's network if the department determines |
19 | that to do so is in the best interests of consumers of services. |
20 | The secretary shall determine the schedule for phasing in |
21 | contracts with managing entities. The managing entities shall, |
22 | at a minimum, be accountable for the operational oversight of |
23 | the delivery of behavioral health services funded by the |
24 | department and for the collection and submission of the required |
25 | data pertaining to these contracted services. A managing entity |
26 | shall serve a geographic area designated by the department. The |
27 | geographic area must be of sufficient size in population and |
28 | have enough public funds for behavioral health services to allow |
29 | for flexibility and maximum efficiency. A provider located |
30 | within a judicial circuit or other designated geographic area |
31 | which demonstrates the capacity to fulfill the goals and |
32 | essential elements set forth in subsections (5) and (6) shall be |
33 | exempt from participating in a managing entity. |
34 | Section 2. This act shall take effect July 1, 2010. |
