    2         An act relating to bribery or the misuse of public
    3         office; amending s. 838.014, F.S.; redefining the term
    4         “public servant” to include a governmental agent for
    5         purposes of coverage by ch. 838, F.S.; providing an
    6         effective date.

    8  Be It Enacted by the Legislature of the State of Florida:
    9  
   10         Section 1. Subsection (6) of section 838.014, Florida
   11  Statutes, is amended to read:
   12         838.014 Definitions.—As used in this chapter, the term:
   13         (6) “Public servant” means:
   14         (a) Any officer or employee of a state, county, municipal,
   15  or special district agency or entity;
   16         (b) Any legislative or judicial officer or employee;
   17         (c) Any person, except a witness, who acts as a general or
   18  special magistrate, receiver, auditor, arbitrator, umpire,
   19  referee, consultant, agent, or hearing officer while performing
   20  a governmental function; or
   21         (d) A candidate for election or appointment to any of the
   22  positions listed in this subsection, or an individual who has
   23  been elected to, but has yet to officially assume the
   24  responsibilities of, public office.
   25         Section 2. This act shall take effect July 1, 2010.
