A bill to be entitled
2An act relating to Manatee County; revising the legal
3boundaries of the City of Anna Maria to remove land from
4the city that is currently included in the boundaries of
5the City of Anna Maria and the City of Holmes Beach, with
6the land remaining in the City of Holmes Beach; amending
7the boundaries of the City of Holmes Beach to include
8unincorporated land to streamline provision of police
9protection and provision of county codes to property
10leased by the county and to all facilities, improvements,
11operations, and activities located on or occurring at such
12leased property; providing an effective date.

14Be It Enacted by the Legislature of the State of Florida:
15
16     Section 1.  Section 2.01 of article II of the Charter of
17the City of Anna Maria is amended to read:
18
ARTICLE II.  CORPORATE LIMITS
19     Sec. 2.01.  Corporate limits description.
20The municipal boundaries and included land areas of the City of
21Anna Maria are described as follows:
22All of that land comprising Anna Maria Island embraced
23in U.S. Lot I in Section 7; Lots 1, 2, 3, 4, and 5 in
24Section 18; and Lot 2 Lots 2, 3 and 4 in Section 17;
25all being in Township 34 South, Range 16 East; along
26with all that land comprising Anna Maria Island
27embraced in Section 12, Township 34 South, Range 15
28East; along with all lands which have either been
29artificially added or naturally accreted to these
30described lands, and all contiguous submerged lands
31described herein, all being within Manatee County,
32Florida.

34Being more particularly described as follows:

36Begin at the Southeasterly corner of U.S. Government
37Lot 5, Section 18, Township 34 South, Range 16 East;
38thence Westerly along the Southerly line of said
39Section 18 to the intersection with the most seaward
40mean lower low water line for The Gulf of Mexico;
41thence North-Northwesterly along the sinousities of
42the said mean lower low waterline to the most
43northerly tip of Anna Maria Island; thence North,
44perpendicular to the mean lower low waterline, a
45distance of 10 feet; thence Easterly and Southeasterly
46along a line 10 feet waterward of, and parallel to,
47the sinousities of the mean lower low waterline of
48Tampa Bay to the intersection with a line 50 feet
49Northwesterly of, and parallel to, the center of the
50Rod and Reel Pier; thence N.36°13'E., along said
51parallel line, a distance of 270 feet more or less;
52thence S.53°47'E., a distance of 100 feet; thence
53S.36°13'W., a distance of 270 feet more or less to a
54point 10 feet waterward from the mean lower low
55waterline; thence Southeasterly along said line 10
56feet waterward of, and parallel to, the sinousities of
57the mean lower low waterline of Tampa Bay, a distance
58of 2450 feet more or less to the intersection with a
59line 600 feet Northwesterly of, and parallel to, the
60centerline of the City Pier; thence N.36°44'E., along
61said parallel line, a distance of 400 feet more or
62less; thence S.53°16'E., a distance of 500 feet;
63thence N.36°44'E., parallel to and 100 feet from the
64centerline of City Pier, a distance of 360 feet;
65thence S.53°16E., 50 feet Northeasterly of the
66northeasterly end of said Pier, a distance of 211
67feet; thence S36°44'W., a distance of 162 feet; thence
68N.53°16'W., a distance of 57 feet: thence S36°44'W.
69along a line parallel to and 50 southeasterly of the
70centerline of said Pier, a distance of 530 feet more
71or less to a point 10 feet waterward from the mean
72lower low waterline; thence Southeasterly along a line
7310 feet waterward of, and parallel to, the sinousities
74of the mean lower low waterline of Tampa Bay, and into
75the to the Mouth of the inlet to Bimini Bay; thence in
76southwestery direction to a point of tangency with a
77line 30 feet waterward of the mean lower low water
78line of the spoil island located to the southwest of a
79Galati's Marina; thence Westerly along said line 30
80feet waterward of, and parallel to, the sinousities of
81the mean lower low waterline of Bimini Bay, and the
82projection thereof to a line 30 westerly of the said
83Marina's docks to a point 30 feet waterward from the
84mean lower low waterline of Bimini Bay; thence
85Westerly along said line 30 feet waterward of, and
86parallel to, the sinousities of the mean lower low
87waterline of Bimini Bay, said line shall run outside
88of any canal system and shall project across and not
89being influenced by the entrances to said canals to
90the intersection of the Easterly line of Section 18,
91Township 34 South, Range 16 East; thence Southerly
92along said Section line a distance of 2600 feet more
93or less to the point of beginning. Containing 550
94acres more or less.

96Provided, however, that the City shall have the power to
97change its boundaries in the manner hereinafter or as
98otherwise defined by the laws of the State of Florida.
99     Section 2.  Section 2.01 of article II of the Charter of
100the City of Holmes Beach is amended to read:

106U.S. Lot 1, Section 16, U.S. Lots 1, 3, 4, Section 17,
107U.S. Lot 1, Section 19, U.S. Lots 1, 2, 3, 4, 5, 6, 7,
108Section 20, U.S. Lots 1, 2, Section 21, U.S. Lot 1,
109Section 29, U.S. Lots 1, 2, 3, together with that
110portion of the causeway for State Road 64 lying
111immediately East of the eastern boundary of U.S. Lot
1123, bounded on the west by said eastern boundary of
113U.S. Lot 3 and bounded on the north, east and south by
114the mean high water line of Anna Maria Sound (Sarasota
115Pass), Section 28, U.S. Lot 1, Section 33 all in
116Township 34 South, Range 16E with a southern boundary
117described as follows: Starting at Sarasota Pass
118continuing westerly along the entire southern boundary
119as shown on the Sunrise Park Plat (page 31, Plat Book
12010, County of Manatee 1957) continuing westerly along
121the south line of Lots 20 and 1 of Block 33 of the
122Ilexhurst Plat (page 154 Plat Book 1, County of
123Manatee, 1911) to Gulf Drive thence northerly along
124Gulf Drive approximately 50 ft. thence westerly
125approximately 100 ft. along the south line of Lot 19
126Block 34 Ilexhurst Plat thence northerly approximately
127100 ft. along the west line of Lots 19 and 18, Block
12834 Ilexhurst Plat thence westerly to the Gulf of
129Mexico. Such property being otherwise described as
130beginning at the City Limits of the City of Anna Maria
131on the north and continuing easterly and southerly
132from said city limits to the above described southern
133boundary otherwise described as the northern boundary
134of the City of Bradenton Beach.

136Provided, however, that the said city shall have power to
137change its boundaries in the manner hereinafter or as
138otherwise by the laws of the State of Florida provided.
139     Section 3.  The additional property described in section 2
140is owned by the Department of Transportation and leased to
141Manatee County for a public use recreation area. In the exercise
142of police powers and jurisdictional authority within the
143property added in section 2, the City of Holmes Beach shall
144apply the provisions of the Manatee County Comprehensive Plan,
145Manatee County Land Development Code, Manatee County Code of
146Ordinances, and Manatee County codes, ordinances, resolutions,
147rules, and regulations to this property and all facilities,
148improvements, operations, and activities located on or occurring
149at the property that is leased by Manatee County from the
150Department of Transportation or its successor during the term of
151any lease agreement and any renewal of such lease agreement.
152     Section 4.  This act shall take effect upon becoming a law.
