A bill to be entitled
2An act relating to Manatee County; amending chapter 30561
3(1955), Laws of Florida, as amended; revising the legal
4boundaries of the City of Anna Maria to remove land that
5is currently included in the boundaries of the City of
6Holmes Beach and to include described submerged lands;
7exempting Manatee County from certain regulations of the
8City of Anna Maria; revising the boundaries of the City of
9Holmes Beach to include unincorporated land owned by the
10Department of Transportation; providing an effective date.

12Be It Enacted by the Legislature of the State of Florida:
13
14     Section 1.  Section 6 of chapter 30561 (1955), Laws of
15Florida, as amended by chapter 2002-384, Laws of Florida, is
16amended to read:

ARTICLE I
18
GENERAL PROVISIONS
19     Section 6.  The boundaries of the area which shall be
20included in the territory of the City of Anna Maria Island, also
21known as the City of Anna Maria, in Manatee County, Florida,
22shall be as follows:
23
24All of that land comprising Anna Maria Island embraced
25in U.S. Lot I in Section 7; Lots 1, 2, 3, 4, and 5 in
26Section 18; and Lot 2 Lots 2, 3 and 4 in Section 17;
27all being in Township 34 South, Range 16 East; along
28with all that land comprising Anna Maria Island
29embraced in Section 12, Township 34 South, Range 15
30East; along with all lands which have either been
31artificially added or naturally accreted to these
32described lands, and all contiguous submerged lands
33described herein, all being within Manatee County,
34Florida.

36Being more particularly described as follows:

38Begin at the Southeasterly corner of U.S. Government
39Lot 5, Section 18, Township 34 South, Range 16 East;
40thence Westerly along the Southerly line of said
41Section 18 to the intersection with the most seaward
42mean lower low water line for The Gulf of Mexico;
43thence North-Northwesterly along the sinousities of
44the said mean lower low waterline to the most
45northerly tip of Anna Maria Island; thence North,
46perpendicular to the mean lower low waterline, a
47distance of 10 feet; thence Easterly and Southeasterly
48along a line 10 feet waterward of, and parallel to,
49the sinousities of the mean lower low waterline of
50Tampa Bay to the intersection with a line 50 feet
51Northwesterly of, and parallel to, the center of the
52Rod and Reel Pier; thence N.36°13'E., along said
53parallel line, a distance of 270 feet more or less;
54thence S.53°47'E., a distance of 100 feet; thence
55S.36°13'W., a distance of 270 feet more or less to a
56point 10 feet waterward from the mean lower low
57waterline; thence Southeasterly along said line 10
58feet waterward of, and parallel to, the sinousities of
59the mean lower low waterline of Tampa Bay, a distance
60of 2450 feet more or less to the intersection with a
61line 600 feet Northwesterly of, and parallel to, the
62centerline of the City Pier; thence N.36°44'E., along
63said parallel line, a distance of 400 feet more or
64less; thence S.53°16'E., a distance of 500 feet;
65thence N.36°44'E., parallel to and 100 feet from the
66centerline of City Pier, a distance of 360 feet;
67thence S.53°16'E., 50 feet Northeasterly of the
68northeasterly end of said Pier, a distance of 211
69feet; thence S.36°44'W., a distance of 162 feet;
70thence N.53°16'W., a distance of 57 feet: thence
71S.36°44'W. along a line parallel to and 50
72southeasterly of the centerline of said Pier, a
73distance of 530 feet more or less to a point 10 feet
74waterward from the mean lower low waterline; thence
75Southeasterly along a line 10 feet waterward of, and
76parallel to, the sinousities of the mean lower low
77waterline of Tampa Bay, and into the to the Mouth of
78the inlet to Bimini Bay; thence in southwestery
79direction to a point of tangency with a line 30 feet
80waterward of the mean lower low water line of the
81spoil island located to the southwest of a Galati's
82Marina; thence Westerly along said line 30 feet
83waterward of, and parallel to, the sinousities of the
84mean lower low waterline of Bimini Bay, and the
85projection thereof to a line 30 westerly of the said
86Marina's docks to a point 30 feet waterward from the
87mean lower low waterline of Bimini Bay; thence
88Westerly along said line 30 feet waterward of, and
89parallel to, the sinousities of the mean lower low
90waterline of Bimini Bay, said line shall run outside
91of any canal system and shall project across and not
92being influenced by the entrances to said canals to
93the intersection of the Easterly line of Section 18,
94Township 34 South, Range 16 East; thence Southerly
95along said Section line a distance of 2600 feet more
96or less to the point of beginning. Containing 550
97acres more or less.

99Provided, however, that the City shall have the power to change
100its boundaries in the manner hereinafter or as otherwise defined
101by the laws of the State of Florida.
102     Section 2.  Notwithstanding section 1, Manatee County shall
103be exempt from any codes, ordinances, resolutions, rules, and
104regulations of the City of Anna Maria relating to construction,
105installation, placement, or location of county structures,
106signage, markers, navigation aids, and other facilities and
107improvements within waters which were previously under the
108jurisdiction of Manatee County before the effective date of this
109act.
110     Section 3.  Section 2.01 of article II of the Charter of
111the City of Holmes Beach is amended to read:

ARTICLE II.  CORPORATE LIMITS
113     Sec. 2.01.  Corporate limits description.
114The municipal boundaries and included land areas of the City of
115Holmes Beach are described as follows:

117U.S. Lot 1, Section 16, U.S. Lots 1, 3, 4, Section 17,
118U.S. Lot 1, Section 19, U.S. Lots 1, 2, 3, 4, 5, 6, 7,
119Section 20, U.S. Lots 1, 2, Section 21, U.S. Lot 1,
120Section 29, U.S. Lots 1, 2, 3, together with that
121portion of the causeway for State Road 64 lying
122immediately East of the eastern boundary of U.S. Lot
1233, bounded on the west by said eastern boundary of
124U.S. Lot 3 and bounded on the north, east and south by
125the mean high water line of Anna Maria Sound (Sarasota
126Pass), Section 28, U.S. Lot 1, Section 33 all in
127Township 34 South, Range 16E with a southern boundary
128described as follows: Starting at Sarasota Pass
129continuing westerly along the entire southern boundary
130as shown on the Sunrise Park Plat (page 31, Plat Book
13110, County of Manatee 1957) continuing westerly along
132the south line of Lots 20 and 1 of Block 33 of the
133Ilexhurst Plat (page 154 Plat Book 1, County of
134Manatee, 1911) to Gulf Drive thence northerly along
135Gulf Drive approximately 50 ft. thence westerly
136approximately 100 ft. along the south line of Lot 19
137Blocxk 34 Ilexhurst Plat thence northerly
138approximately 100 ft. along the west line of Lots 19
139and 18, Block 34 Ilexhurst Plat thence westerly to the
140Gulf of Mexico. Such property being otherwise
141described as beginning at the City Limits of the City
142of Anna Maria on the north and continuing easterly and
143southerly from said city limits to the above described
144southern boundary otherwise described as the northern
145boundary of the City of Bradenton Beach.

147Provided, however, that the said city shall have power to change
148its boundaries in the manner hereinafter or as otherwise by the
149laws of the State of Florida provided.
150     Section 4.  The additional property described in section 3
151is owned by the Department of Transportation and a portion is
152leased to Manatee County for a public use recreation area. In
153the exercise of police powers and jurisdictional authority
154within the property added in section 3, the City of Holmes Beach
155shall apply the provisions of the Manatee County Comprehensive
156Plan, Manatee County Land Development Code, Manatee County Code
157of Ordinances, and Manatee County codes, ordinances,
158resolutions, rules, and regulations to this property and all
159facilities, improvements, operations, and activities located on
160or occurring at the property that is leased by Manatee County
161from the Department of Transportation or its successor during
162the term of any lease agreement and any renewal of such lease
163agreement.
164     Section 5.  This act shall take effect upon becoming a law.
