A bill to be entitled
2An act relating to career offenders; amending s. 775.261,
3F.S.; prohibiting specified acts done with intent to
4assist a career offender in eluding a law enforcement
5agency that is seeking to find the career offender to
6question the career offender about, or to arrest the
7career offender for, his or her noncompliance; providing
8penalties; providing that such provisions are inapplicable
9to career offenders incarcerated in or in the custody of
10specified facilities; providing an effective date.

12Be It Enacted by the Legislature of the State of Florida:

14     Section 1.  Subsection (10) is added to section 775.261,
15Florida Statutes, to read:
16     775.261  The Florida Career Offender Registration Act.-
17     (10)  ASSISTING IN NONCOMPLIANCE.-Any person who has reason
18to believe that a career offender is not complying, or has not
19complied, with the requirements of this section and who, with
20the intent to assist the career offender in eluding a law
21enforcement agency that is seeking to find the career offender
22to question the career offender about, or to arrest the career
23offender for, his or her noncompliance with the requirements of
24this section:
25     (a)  Withholds information from, or does not notify, the
26law enforcement agency about the career offender's noncompliance
27with the requirements of this section, and, if known, the
28whereabouts of the career offender;
29     (b)  Harbors or attempts to harbor, or assists another
30person in harboring or attempting to harbor, the career
31offender;
32     (c)  Conceals or attempts to conceal, or assists another
33person in concealing or attempting to conceal, the career
34offender; or
35     (d)  Provides information to the law enforcement agency
36regarding the career offender that the person knows to be false
37information,

39commits a felony of the third degree, punishable as provided in
40s. 775.082, s. 775.083, or s. 775.084. This subsection does not
41apply if the career offender is incarcerated in or is in the
42custody of a state correctional facility, a private correctional
43facility, a local jail, or a federal correctional facility.
44     Section 2.  This act shall take effect October 1, 2010.
