    1                        A bill to be entitled                      
    2         An act relating to an environmental surcharge on
    3         bottled water; establishing a surcharge on bottled
    4         water sold at retail in this state; requiring that
    5         moneys collected from the surcharge be deposited into
    6         the Ecosystem Management and Restoration Trust Fund;
    7         providing an effective date.

    9  Be It Enacted by the Legislature of the State of Florida:
   10  
   11         Section 1. (1) An environmental surcharge is imposed on
   12  each bottle of water sold in the amount of 6 percent of the
   13  sales price of each item, article, or group of items of or
   14  containing bottled water when sold at retail in this state.
   15         (2) All moneys collected from the surcharge levied under
   16  this section shall be deposited into the Ecosystem Management
   17  and Restoration Trust Fund within the Department of
   18  Environmental Protection.
   19         (3) The surcharge levied under this section shall be
   20  administered, collected, and enforced in the same manner as the
   21  tax imposed under s. 212.05, Florida Statutes.
   22         Section 2. This act shall take effect July 1, 2010.
