A bill to be entitled
2An act relating to the Florida State Employees' Charitable
3Campaign; amending s. 110.181, F.S.; deleting the
4requirement to establish local steering committees;
5requiring undesignated campaign funds to be shared
6proportionally by the participating charitable
7organizations based on the percentage of designations in
8each area; providing an effective date.

10Be It Enacted by the Legislature of the State of Florida:
11
12     Section 1.  Subsection (2) of section 110.181, Florida
13Statutes, is amended to read:
14     110.181  Florida State Employees' Charitable Campaign.-
15     (2)  SELECTION OF FISCAL AGENTS; COST.-
16     (a)  The Department of Management Services shall select
17through the competitive procurement process a fiscal agent or
18agents to receive, account for, and distribute charitable
19contributions among participating charitable organizations.
20     (b)  The fiscal agent shall withhold the reasonable costs
21for conducting the campaign and for accounting and distribution
22to the participating organizations and shall reimburse the
23department the actual cost, not to exceed 1 percent of gross
24pledges, for coordinating the campaign in accordance with the
25rules of the department. In any fiscal year in which the
26Legislature specifically appropriates to the department its
27total costs for coordinating the campaign from the General
28Revenue Fund, the fiscal agent is not required to reimburse such
29costs to the department under this subsection. Otherwise,
30reimbursement will be the difference between actual costs and
31the amount appropriated.
32     (c)  The fiscal agent shall furnish the department and
33participating charitable organizations a report of the
34accounting and distribution activities. Records relating to
35these activities shall be open for inspection upon reasonable
36notice and request.
37     (d)  A local steering committee shall be established in
38each fiscal agent area to assist in conducting the campaign and
39to direct the distribution of undesignated funds remaining after
40partial distribution pursuant to paragraph (e). The committee
41shall be composed of state employees selected by the fiscal
42agent from among recommendations provided by interested
43participating organizations, if any, and approved by the
44Statewide Steering Committee.
45     (d)(e)  Participating charitable organizations that provide
46direct services in a local fiscal agent's area shall receive the
47same percentage of undesignated funds as the percentage of
48designated funds they receive in the campaign. The payment of
49each charity's share of undesignated funds shall be distributed
50in the same manner as the designations. The undesignated funds
51remaining following allocation to these charitable organizations
52shall be distributed by the local steering committee.
53     Section 2.  This act shall take effect July 1, 2010.
