2 An act relating to a review under the Open Government
3 Sunset Review Act; amending s. 627.0628, F.S.,
4 relating to an exemption from public-records
5 requirements for trade secrets submitted by private
6 companies to the Florida Commission on Hurricane Loss
7 Projection Methodology, the Office of Insurance
8 Regulation, or the consumer advocate and an exemption
9 from public-meetings requirements for portions of
10 meetings or rate proceedings wherein trade secrets are
11 discussed; saving the exemptions from repeal under the
12 Open Government Sunset Review Act; deleting provisions
13 that provide for repeal of the exemptions; providing
14 an effective date.

16 Be It Enacted by the Legislature of the State of Florida:

18 Section 1. Paragraph (f) of subsection (3) of section
19 627.0628, Florida Statutes, is amended to read:

21 Methodology; public records exemption; public meetings
22 exemption.—
23 (3) ADOPTION AND EFFECT OF STANDARDS AND GUIDELINES.—
24 (f)1. A trade secret, as defined in s. 812.081, that is
25 used in designing and constructing a hurricane loss model and
26 that is provided pursuant to this section, by a private company,
27 to the commission, office, or consumer advocate appointed
28 pursuant to s. 627.0613, is confidential and exempt from s.
29 119.07(1) and s. 24(a), Art. I of the State Constitution.
30 2. That portion of a meeting of the commission or of a rate
31 proceeding on an insurer’s rate filing at which a trade secret
32 made confidential and exempt by this paragraph is discussed is
33 exempt from s. 286.011 and s. 24(b), Art. I of the State
34 Constitution.
35 3. This paragraph is subject to the Open Government Sunset
36 Review Act in accordance with s. 119.15, and shall stand
37 repealed on October 2, 2010, unless reviewed and saved from
38 repeal through reenactment by the Legislature.
39 Section 2. This act shall take effect October 1, 2010.
