Florida Senate - 2010 CS for SB 1754 By the Committee on Community Affairs; and Senator Altman 578-03536-10 20101754c1 1 A bill to be entitled 2 An act relating to enterprise zones; creating s. 3 290.00726, F.S.; authorizing the City of Palm Bay to 4 apply to the Office of Tourism, Trade, and Economic 5 Development for designation of an enterprise zone; 6 providing an application deadline; providing 7 requirements for the area of the enterprise zone; 8 requiring the office to establish the effective date 9 of the enterprise zone; amending s. 290.0055, F.S.; 10 authorizing certain governing bodies to apply to the 11 Office of Tourism, Trade, and Economic Development to 12 amend the boundary of an enterprise zone that includes 13 a rural area of critical economic concern; providing a 14 limitation; authorizing the office to approve the 15 amendment application subject to certain requirements; 16 requiring that the office establish the effective date 17 of certain enterprise zones; creating s. 290.00727, 18 F.S.; authorizing Martin County to apply to the Office 19 of Tourism, Trade, and Economic Development for 20 designation of an enterprise zone; providing 21 application requirements; authorizing the office to 22 designate an enterprise zone in Martin County; 23 providing responsibilities of the office; providing an 24 effective date. 25 26 Be It Enacted by the Legislature of the State of Florida: 27 28 Section 1. Section 290.00726, Florida Statutes, is created 29 to read: 30 290.00726 Enterprise zone designation for the City of Palm 31 Bay.—The City of Palm Bay may apply to the Office of Tourism, 32 Trade, and Economic Development for designation of one 33 enterprise zone for an area within the northeast portion of the 34 city, which zone shall encompass an area up to 5 square miles. 35 The application must be submitted by December 31, 2011, and must 36 comply with the requirements of s. 290.0055. Notwithstanding s. 37 290.0065 limiting the total number of enterprise zones 38 designated and the number of enterprise zones within a 39 population category, the Office of Tourism, Trade, and Economic 40 Development may designate one enterprise zone under this 41 section. The Office of Tourism, Trade, and Economic Development 42 shall establish the initial effective date of the enterprise 43 zone designated under this section. 44 Section 2. Paragraph (d) is added to subsection (6) of 45 section 290.0055, Florida Statutes, to read: 46 290.0055 Local nominating procedure.— 47 (6) 48 (d)1. The governing body of a jurisdiction which nominated 49 the application for an enterprise zone that includes a portion 50 of the state designated as a rural area of critical economic 51 concern pursuant to s. 288.0656(7) may apply to the Office of 52 Tourism, Trade, and Economic Development to expand the boundary 53 of the enterprise zone by not more than 3 square miles. Such 54 application must be submitted by December 31, 2011. 55 2. Notwithstanding the area limitations specified in 56 subsection (4), the Office of Tourism, Trade, and Economic 57 Development may approve the request for a boundary amendment if 58 the area continues to satisfy the remaining requirements of this 59 section. 60 3. The Office of Tourism, Trade, and Economic Development 61 shall establish the initial effective date of an enterprise zone 62 designated under this paragraph. 63 Section 3. Section 290.00727, Florida Statutes, is created 64 to read: 65 290.00727 Enterprise zone designation for Martin County. 66 Martin County may apply to the Office of Tourism, Trade, and 67 Economic Development for designation of one enterprise zone for 68 an area within Martin County, which zone shall encompass an area 69 up to 10 square miles consisting of land within the primary 70 urban services boundary and focusing on Indiantown, but 71 excluding property owned by Florida Power and Light to the west, 72 two areas to the north designated as estate residential, and the 73 county-owned Timer Powers Recreational Area. Within the 74 designated enterprise zone, Martin County shall exempt 75 residential condominiums from benefiting from state enterprise 76 zone incentives, unless prohibited by law. The application must 77 be submitted by December 31, 2010, and must comply with the 78 requirements of s. 290.0055. Notwithstanding s. 290.0065 79 limiting the total number of enterprise zones designated and the 80 number of enterprise zones within a population category, the 81 Office of Tourism, Trade, and Economic Development may designate 82 one enterprise zone under this section. The Office of Tourism, 83 Trade, and Economic Development shall establish the initial 84 effective date of the enterprise zone designated pursuant to 85 this section. 86 Section 4. This act shall take effect January 1, 2011.
