Florida Senate - 2010 SB 1768 By Senator Altman 24-01764-10 20101768__ 1 A bill to be entitled 2 An act relating to procurement of commodities and 3 contractual services; creating s. 287.05705, F.S.; 4 providing that an agency, county, or municipality that 5 is required to make purchases of commodities or 6 contractual services through competitive solicitation 7 must provide vendors the option to submit competitive 8 sealed bids through a uniform secure electronic 9 interactive Internet system; requiring specified 10 notification in invitations to bid; requiring the 11 Department of Management Services to adopt rules 12 establishing procedures and requirements for the 13 electronic submission, receipt, and processing of 14 competitive sealed bids; providing exemptions; 15 providing an effective date. 16 17 Be It Enacted by the Legislature of the State of Florida: 18 19 Section 1. Section 287.05705, Florida Statutes, is created 20 to read: 21 287.05705 Online submission of competitive sealed bids.— 22 (1) Except as provided in subsections (4) and (5), an 23 agency, county, or municipality that is required to make 24 purchases of commodities or contractual services through 25 competitive solicitation must provide vendors the option to 26 submit competitive sealed bids through a uniform secure 27 electronic interactive Internet system. 28 (2) Agencies, counties, and municipalities must include in 29 invitations to bid notification to vendors apprising them of the 30 option to submit sealed bids electronically and of any special 31 conditions, requirements, or procedures particular to electronic 32 submissions of competitive sealed bids. 33 (3) The department shall adopt rules establishing 34 procedures and requirements for the electronic submission, 35 receipt, and processing of competitive sealed bids under this 36 section. 37 (4) A county or municipality that is without available 38 high-speed Internet access is exempt from the requirements of 39 subsections (1) and (2) until such time as high-speed Internet 40 access becomes available to the county or municipality. 41 (5) A county or municipality having a population of fewer 42 than 25,000 is exempt from the requirements of subsections (1) 43 and (2). 44 Section 2. This act shall take effect July 1, 2010.
