    2         An act relating to the sale of tires; creating s.
    3         501.94, F.S.; prohibiting the sale of certain old
    4         tires; providing for enforcement by the Department of
    5         Agriculture and Consumer Services; providing
    6         penalties; providing for administration and the
    7         adoption of rules; providing an effective date.

    9  Be It Enacted by the Legislature of the State of Florida:
   10  
   11         Section 1. Section 501.94, Florida Statutes, is created to
   12  read:
   13         501.94 Sale of old tires prohibited.—
   14         (1)(a) Any new or used motor vehicle dealer or other
   15  business that sells tires may not sell a new or used tire that
   16  is more than 6 years old, based on the date that the tire was
   17  manufactured.
   18         (b) A person who violates this section is subject to a
   19  civil fine, not to exceed $250 per violation, which shall be
   20  imposed by the Department of Agriculture and Consumer Services
   21  and transferred to the General Inspection Trust Fund and used to
   22  fund the administration of this section.
   23         (2) The Department of Agriculture and Consumer Services
   24  shall enforce this section and shall adopt rules and take any
   25  necessary actions to administer it.
   26         Section 2. This act shall take effect July 1, 2010.
