    1                        A bill to be entitled                      
    2         An act relating to contributions to relieve
    3         homelessness; amending s. 320.02, F.S.; requiring the
    4         motor vehicle registration form and registration
    5         renewal form to include an option to make a voluntary
    6         contribution to aid the homeless; amending s. 322.08,
    7         F.S.; requiring the driver’s license application form
    8         to include an option to make a voluntary contribution
    9         to aid the homeless; amending s. 322.18, F.S.;
   10         requiring the driver’s license application form for
   11         renewal issuance or renewal extension to include an
   12         option to make a voluntary contribution to aid the
   13         homeless; providing that voluntary contributions for
   14         the homeless are not income of a revenue nature for
   15         the purpose of applying certain service charges;
   16         providing for such contributions to be deposited into
   17         the Grants and Donations Trust Fund of the Department
   18         of Children and Family Services and used by the State
   19         Office on Homelessness for certain purposes; providing
   20         an effective date.

   22  Be It Enacted by the Legislature of the State of Florida:
   23  
   24         Section 1. Paragraph (i) is added to subsection (15) of
   25  section 320.02, Florida Statutes, to read:
   26         320.02 Registration required; application for registration;
   27  forms.—
   28         (15)
   29         (i)Notwithstanding s. 320.23, the application form for
   30  motor vehicle registration and renewal of registration must
   31  include language permitting a voluntary contribution of $1 per
   32  applicant to aid the homeless. Contributions made pursuant to
   33  this paragraph shall be deposited into the Grants and Donations
   34  Trust Fund of the Department of Children and Family Services and
   35  used by the State Office on Homelessness to supplement grants
   36  made under s. 420.622(4) and (5), provide information to the
   37  public about homelessness in the state, and provide literature
   38  for homeless persons seeking assistance.

   40  For the purpose of applying the service charge provided in s.
   41  215.20, contributions received under this subsection are not
   42  income of a revenue nature.
   43         Section 2. Subsection (7) of section 322.08, Florida
   44  Statutes, is amended to read:
   45         322.08 Application for license.—
   46         (7) The application form for a driver’s license or
   47  duplicate thereof shall include language permitting the
   48  following:
   49         (a) A voluntary contribution of $1 per applicant, which
   50  contribution shall be deposited into the Health Care Trust Fund
   51  for organ and tissue donor education and for maintaining the
   52  organ and tissue donor registry.
   53         (b) A voluntary contribution of $1 per applicant, which
   54  contribution shall be distributed to the Florida Council of the
   55  Blind.
   56         (c) A voluntary contribution of $2 per applicant, which
   57  shall be distributed to the Hearing Research Institute,
   58  Incorporated.
   59         (d) A voluntary contribution of $1 per applicant, which
   60  shall be distributed to the Juvenile Diabetes Foundation
   61  International.
   62         (e) A voluntary contribution of $1 per applicant, which
   63  shall be distributed to the Children’s Hearing Help Fund.
   64         (f) A voluntary contribution of $1 per applicant, which
   65  shall be distributed to Family First, a nonprofit organization.
   66         (g) A voluntary contribution of $1 per applicant, to Stop
   67  Heart Disease, which shall be distributed to the Florida Heart
   68  Research Institute, a nonprofit organization.
   69         (h)Notwithstanding s. 322.081, a voluntary contribution of
   70  $1 per applicant to aid the homeless. Contributions made
   71  pursuant to this paragraph shall be deposited into the Grants
   72  and Donations Trust Fund of the Department of Children and
   73  Family Services and used by the State Office on Homelessness to
   74  supplement grants made under s. 420.622(4) and (5), provide
   75  information to the public about homelessness in the state, and
   76  provide literature for homeless persons seeking assistance.

   78  A statement providing an explanation of the purpose of the trust
   79  funds shall also be included. For the purpose of applying the
   80  service charge provided in s. 215.20, contributions received
   81  under paragraphs (b), (c), (d), (e), (f), and (g), and (h) and
   82  under s. 322.18(9) are not income of a revenue nature.
   83         Section 3. Subsection (9) of section 322.18, Florida
   84  Statutes, is amended to read:
   85         322.18 Original applications, licenses, and renewals;
   86  expiration of licenses; delinquent licenses.—
   87         (9)(a) The application form for a renewal issuance shall
   88  include language permitting a voluntary contribution of $1 per
   89  applicant, to be quarterly distributed by the department to
   90  Prevent Blindness Florida, a not-for-profit organization, to
   91  prevent blindness and preserve the sight of the residents of
   92  this state. A statement providing an explanation of the purpose
   93  of the funds shall be included with the application form. Prior
   94  to the department distributing the funds collected pursuant to
   95  this paragraph, Prevent Blindness Florida must submit a report
   96  to the department that identifies how such funds were used
   97  during the preceding year.
   98         (b) The application form for a renewal issuance or renewal
   99  extension shall include language permitting a voluntary
  100  contribution of $1 per applicant to Family First.
  101         (c)The application form for a renewal issuance or renewal
  102  extension shall include language permitting a voluntary
  103  contribution of $1 per applicant to aid the homeless.
  104  Contributions made pursuant to this paragraph shall be deposited
  105  into the Grants and Donations Trust Fund of the Department of
  106  Children and Family Services and used by the State Office on
  107  Homelessness to supplement grants made under s. 420.622(4) and
  108  (5), provide information to the public about homelessness in the
  109  state, and provide literature for homeless persons seeking
  110  assistance.
  111         Section 4. This act shall take effect July 1, 2010.
