    1                        A bill to be entitled                      
    2         An act relating to citrus canker eradication;
    3         repealing s. 581.1845, F.S., relating to the citrus
    4         canker eradication program and the payment of
    5         compensation to eligible homeowners whose citrus trees
    6         have been removed under the program; amending s.
    7         215.22, F.S.; deleting an exemption from a service
    8         charge imposed on income of a revenue nature deposited
    9         in trust funds for funds held for the payment of
   10         citrus canker eradication and compensation to conform;
   11         amending s. 933.02, F.S.; deleting a cross-reference
   12         to conform; providing an effective date.

   14  Be It Enacted by the Legislature of the State of Florida:
   15  
   16         Section 1. Section 581.1845, Florida Statutes, is repealed.
   17         Section 2. Paragraphs (i) through (w) of subsection (1) of
   18  section 215.22, Florida Statutes, are redesignated as paragraphs
   19  (h) through (v), respectively, and present paragraph (h) of that
   20  subsection is amended to read:
   21         215.22 Certain income and certain trust funds exempt.—
   22         (1) The following income of a revenue nature or the
   23  following trust funds shall be exempt from the appropriation
   24  required by s. 215.20(1):
   25         (h) Funds held for the payment of citrus canker eradication
   26  and compensation.
   27         Section 3. Paragraph (d) of subsection (4) of section
   28  933.02, Florida Statutes, is amended to read:
   29         933.02 Grounds for issuance of search warrant.—Upon proper
   30  affidavits being made, a search warrant may be issued under the
   31  provisions of this chapter upon any of the following grounds:
   32         (4) When any property is being held or possessed:
   33         (d) In violation of the laws relative to citrus disease
   34  pursuant to s. ss. 581.184 and 581.1845; or
   35  
   36  This section also applies to any papers or documents used as a
   37  means of or in aid of the commission of any offense against the
   38  laws of the state.
   39         Section 4. This act shall take effect July 1, 2010.
