1 A bill to be entitled
2 An act relating to education; providing a short title;
3 amending s. 1011.62, F.S.; requiring that each school
4 district allocate 100 percent of the funds received
5 for instruction for the International Baccalaureate
6 Program, Advanced International Certificate of
7 Education, and the Advanced Placement Program;
8 requiring that such funds be expended solely for
9 administrative costs associated with such programs and
10 teachers’ bonuses; revising provisions relating to the
11 distribution of bonuses for teachers who provide
12 instruction to such programs; amending s. 1007.35,
13 F.S.; revising provisions relating to the duties of
14 the Florida Partnership for Minority and
15 Underrepresented Student Achievement; requiring that
16 the partnership, in cooperation with the Department of
17 Education, post an annual report on the department’s
18 website regarding the Advanced Placement Program;
19 specifying the information that such report must
20 contain; providing an effective date.

22 Be It Enacted by the Legislature of the State of Florida:
23
24 Section 1. This act may be cited as the “High-Performing
25 Teacher Bonuses Act.”
26 Section 2. Paragraphs (m), (n), and (o) of subsection (1)
27 of section 1011.62, Florida Statutes, are amended to read:
28 1011.62 Funds for operation of schools.—If the annual
29 allocation from the Florida Education Finance Program to each
30 district for operation of schools is not determined in the
31 annual appropriations act or the substantive bill implementing
32 the annual appropriations act, it shall be determined as
33 follows:
34 (1) COMPUTATION OF THE BASIC AMOUNT TO BE INCLUDED FOR
35 OPERATION.—The following procedure shall be followed in
36 determining the annual allocation to each district for
37 operation:
38 (m) Calculation of additional full-time equivalent
39 membership based on international baccalaureate examination
40 scores of students.—A value of 0.16 full-time equivalent student
41 membership shall be calculated for each student enrolled in an
42 international baccalaureate course who receives a score of 4 or
43 higher on a subject examination. A value of 0.3 full-time
44 equivalent student membership shall be calculated for each
45 student who receives an international baccalaureate diploma.
46 Such value shall be added to the total full-time equivalent
47 student membership in basic programs for grades 9 through 12 in
48 the subsequent fiscal year. Each school district shall allocate
49 100 percent of the funds received for international
50 baccalaureate instruction to the program that generates such
51 funds. Funds appropriated in accordance with this paragraph may
52 be expended solely for the payment of administrative costs
53 associated with the international baccalaureate program and
54 bonuses for teachers who provide international baccalaureate
55 instruction. Administrative costs shall include costs associated
56 with international baccalaureate annual school fees, examination
57 fees, and professional development for international
58 baccalaureate teachers. The bonus for international
59 baccalaureate teachers shall equal the proportionate value of
60 the 0.16 additional funding minus administrative costs for each
61 eligible student score, or $50 per eligible student score,
62 whichever is greater. The bonus for international baccalaureate
63 teachers in a school designated with a grade of “D” or “F” shall
64 equal 10 times the proportionate value of the 0.16 additional
65 funding minus administrative costs for each eligible student
66 score minus the fees charged for each examination, or $500 per
67 eligible student score, whichever is greater. The school
68 district shall distribute to each classroom teacher who provided
69 international baccalaureate instruction:
70 1. A bonus in the amount of $50 for each student taught by
71 the International Baccalaureate teacher in each international
72 baccalaureate course who receives a score of 4 or higher on the
73 international baccalaureate examination.
74 2. An additional bonus of $500 to each International
75 Baccalaureate teacher in a school designated with a grade of “D”
76 or “F” who has at least one student scoring 4 or higher on the
77 international baccalaureate examination, regardless of the
78 number of classes taught or of the number of students scoring a
79 4 or higher on the international baccalaureate examination.

81 Bonuses awarded to a teacher according to this paragraph shall
82 not exceed $2,000 in any given school year and shall be in
83 addition to any regular wage or other bonus the teacher received
84 or is scheduled to receive.
85 (n) Calculation of additional full-time equivalent
86 membership based on Advanced International Certificate of
87 Education examination scores of students.—A value of 0.16 full
88 time equivalent student membership shall be calculated for each
89 student enrolled in a full-credit Advanced International
90 Certificate of Education course who receives a score of E or
91 higher on a subject examination. A value of 0.08 full-time
92 equivalent student membership shall be calculated for each
93 student enrolled in a half-credit Advanced International
94 Certificate of Education course who receives a score of E or
95 higher on a subject examination. A value of 0.3 full-time
96 equivalent student membership shall be calculated for each
97 student who receives an Advanced International Certificate of
98 Education diploma. Such value shall be added to the total full
99 time equivalent student membership in basic programs for grades
100 9 through 12 in the subsequent fiscal year. Each school district
101 shall allocate 100 percent of the funds received for Advanced
102 International Certificate of Education instruction to the
103 program that generates such funds. Funds appropriated in
104 accordance with this paragraph may be expended solely for the
105 payment of administrative costs associated with the Advanced
106 International Certificate of Education program and bonuses for
107 teachers who provide Advanced International Certificate of
108 Education instruction. Administrative costs shall include costs
109 associated with Advanced International Certificate of Education
110 annual school fees, examination fees, and professional
111 development for Advanced International Certificate of Education
112 teachers. The bonus for Advanced International Certificate of
113 Education teachers shall equal the proportionate value of the
114 0.08 or 0.16 additional funding minus administrative costs for
115 each eligible student score, or $50 per eligible student score,
116 whichever is greater. The bonus for Advanced International
117 Certificate of Education teachers in a school designated with a
118 grade of “D” or “F” shall equal 10 times the proportionate value
119 of the 0.08 or 0.16 additional funding minus administrative
120 costs for each eligible student score minus the fees charged for
121 each examination, or $500 per eligible student score, whichever
122 is greater. The school district shall distribute to each
123 classroom teacher who provided Advanced International
124 Certificate of Education instruction:
125 1. A bonus in the amount of $50 for each student taught by
126 the Advanced International Certificate of Education teacher in
127 each full-credit Advanced International Certificate of Education
128 course who receives a score of E or higher on the Advanced
129 International Certificate of Education examination. A bonus in
130 the amount of $25 for each student taught by the Advanced
131 International Certificate of Education teacher in each half
132 credit Advanced International Certificate of Education course
133 who receives a score of E or higher on the Advanced
134 International Certificate of Education examination.
135 2. An additional bonus of $500 to each Advanced
136 International Certificate of Education teacher in a school
137 designated with a grade of “D” or “F” who has at least one
138 student scoring E or higher on the full-credit Advanced
139 International Certificate of Education examination, regardless
140 of the number of classes taught or of the number of students
141 scoring an E or higher on the full-credit Advanced International
142 Certificate of Education examination.
143 3. Additional bonuses of $250 each to teachers of half
144 credit Advanced International Certificate of Education classes
145 in a school designated with a grade of “D” or “F” which has at
146 least one student scoring an E or higher on the half-credit
147 Advanced International Certificate of Education examination in
148 that class. The maximum additional bonus for a teacher awarded
149 in accordance with this subparagraph shall not exceed $500 in
150 any given school year. Teachers receiving an award under
151 subparagraph 2. are not eligible for a bonus under this
152 subparagraph.

154 Bonuses awarded to a teacher according to this paragraph shall
155 not exceed $2,000 in any given school year and shall be in
156 addition to any regular wage or other bonus the teacher received
157 or is scheduled to receive.
158 (o) Calculation of additional full-time equivalent
159 membership based on college board advanced placement scores of
160 students.—A value of 0.16 full-time equivalent student
161 membership shall be calculated for each student in each advanced
162 placement course who receives a score of 3 or higher on the
163 College Board Advanced Placement Examination for the prior year
164 and added to the total full-time equivalent student membership
165 in basic programs for grades 9 through 12 in the subsequent
166 fiscal year. Each school district shall allocate 100 percent of
167 the funds received for Advanced Placement instruction to the
168 high school that generates such funds. Funds appropriated in
169 accordance with this paragraph may be expended solely for the
170 payment of administrative costs associated with the Advanced
171 Placement program and bonuses for teachers who provide Advanced
172 Placement instruction. Administrative costs shall include costs
173 associated with examination fees and professional development
174 for Advanced Placement teachers. The bonus for Advanced
175 Placement teachers shall equal the proportionate value of the
176 0.16 additional funding minus administrative costs for each
177 eligible student score, or $50 per eligible student score,
178 whichever is greater. The bonus for Advanced Placement teachers
179 in a school designated with a grade of “D” or “F” shall equal 10
180 times the proportionate value of the 0.16 additional funding
181 minus administrative costs for each eligible student score minus
182 the fees charged for each examination, or $500 per eligible
183 student score, whichever is greater. Each district must allocate
184 at least 80 percent of the funds provided to the district for
185 advanced placement instruction, in accordance with this
186 paragraph, to the high school that generates the funds. The
187 school district shall distribute to each classroom teacher who
188 provided advanced placement instruction:
189 1. A bonus in the amount of $50 for each student taught by
190 the Advanced Placement teacher in each advanced placement course
191 who receives a score of 3 or higher on the College Board
192 Advanced Placement Examination.
193 2. An additional bonus of $500 to each Advanced Placement
194 teacher in a school designated with a grade of “D” or “F” who
195 has at least one student scoring 3 or higher on the College
196 Board Advanced Placement Examination, regardless of the number
197 of classes taught or of the number of students scoring a 3 or
198 higher on the College Board Advanced Placement Examination.

200 Bonuses awarded to a teacher according to this paragraph shall
201 not exceed $2,000 in any given school year and shall be in
202 addition to any regular wage or other bonus the teacher received
203 or is scheduled to receive.
204 Section 3. Paragraph (l) is added to subsection (6) of
205 section 1007.35, Florida Statutes, to read:
206 1007.35 Florida Partnership for Minority and
207 Underrepresented Student Achievement.—
208 (6) The partnership shall:
209 (l) In cooperation with the Department of Education, post
210 an annual report on the department’s website on or before August
211 1 of each year which delineates:
212 1. The total number of teachers who participate in
213 professional development associated with Advanced Placement
214 courses, the registration fees associated with such professional
215 development, and the number and value of scholarships awarded by
216 the College Board for teacher participation in Advanced
217 Placement professional development.
218 2. The number of students who enroll in Advanced Placement
219 courses, the number of Advanced Placement courses in which such
220 students enroll, and the number and percentage of students
221 enrolled in Advanced Placement courses who take the College
222 Board Advanced Placement Examination that corresponds to each
223 course, the number and percentage of students enrolled in
224 Advanced Placement courses who take the College Board Advanced
225 Placement Examination and receive a score of 3 or higher, and
226 the number and percentage of students who take the College Board
227 Advanced Placement Examination without having enrolled in the
228 Advanced Placement course and earn a score of 3 or higher. Such
229 information shall be reported by subject, race, and gender.
230 3. The amount paid by the state for each examination and
231 the total rebates provided to each school for the administration
232 of the College Board Advanced Placement Examination.
233 Section 4. This act shall take effect July 1, 2010.
