1 A bill to be entitled
2 An act relating to education; providing a short title;
3 amending s. 1011.62, F.S.; requiring that each school
4 district allocate 100 percent of the funds received
5 for instruction for the International Baccalaureate
6 Program, Advanced International Certificate of
7 Education, and the Advanced Placement Program;
8 requiring that such funds be expended solely for
9 administrative costs associated with such programs and
10 teachers’ bonuses; revising provisions relating to the
11 distribution of bonuses for teachers who provide
12 instruction to such programs; amending s. 1007.35,
13 F.S.; revising provisions relating to the duties of
14 the Florida Partnership for Minority and
15 Underrepresented Student Achievement; requiring that
16 the partnership, in cooperation with the Department of
17 Education, post an annual report on the department’s
18 website regarding the Advanced Placement Program;
19 specifying the information that such report must
20 contain; providing an effective date.

22 Be It Enacted by the Legislature of the State of Florida:
23
24 Section 1. This act may be cited as the “High-Performing
25 Teacher Bonuses Act.”
26 Section 2. Paragraphs (m), (n), and (o) of subsection (1)
27 of section 1011.62, Florida Statutes, are amended to read:
28 1011.62 Funds for operation of schools.—If the annual
29 allocation from the Florida Education Finance Program to each
30 district for operation of schools is not determined in the
31 annual appropriations act or the substantive bill implementing
32 the annual appropriations act, it shall be determined as
33 follows:
34 (1) COMPUTATION OF THE BASIC AMOUNT TO BE INCLUDED FOR
35 OPERATION.—The following procedure shall be followed in
36 determining the annual allocation to each district for
37 operation:
38 (m) Calculation of additional full-time equivalent membership
39 based on international baccalaureate examination scores of
40 students.—A value of 0.16 full-time equivalent student
41 membership shall be calculated for each student enrolled in an
42 international baccalaureate course who receives a score of 4 or
43 higher on a subject examination. A value of 0.3 full-time
44 equivalent student membership shall be calculated for each
45 student who receives an international baccalaureate diploma.
46 Such value shall be added to the total full-time equivalent
47 student membership in basic programs for grades 9 through 12 in
48 the subsequent fiscal year. Each school district shall allocate
49 100 percent of the funds received for international
50 baccalaureate instruction to the school whose students generate
51 such funds and within that school program that generates such
52 funds. Funds allocated in accordance with this paragraph shall
53 be expended solely for the payment of allowable costs associated
54 with the international baccalaureate program and bonuses for
55 teachers who provide international baccalaureate instruction.
56 Such allowable costs are only those associated with
57 international baccalaureate annual school fees, international
58 baccalaureate examination fees, and salaries and benefits for
59 school-based international baccalaureate coordinators;
60 supplemental books, instructional supplies, instructional
61 equipment, or instructional materials for international
62 baccalaureate courses; programs or activities that identify
63 prospective international baccalaureate students or prepare
64 prospective students to enroll in international baccalaureate
65 courses; and training or professional development for
66 international baccalaureate teachers. The bonus for
67 international baccalaureate teachers shall equal the
68 proportionate value of the 0.16 additional funding per eligible
69 student score minus allowable costs, or $50 per eligible student
70 score, whichever is greater. The teacher bonus in a school
71 designated with a grade of “D” or “F” shall be an additional
72 $500 if any one of the teacher’s international baccalaureate
73 students scores 4 or higher on an international baccalaureate
74 examination. The school district shall distribute to each
75 classroom teacher who provided international baccalaureate
76 instruction:
77 1. A bonus in the amount of $50 for each student taught by
78 the International Baccalaureate teacher in each international
79 baccalaureate course who receives a score of 4 or higher on the
80 international baccalaureate examination.
81 2. An additional bonus of $500 to each International
82 Baccalaureate teacher in a school designated with a grade of “D”
83 or “F” who has at least one student scoring 4 or higher on the
84 international baccalaureate examination, regardless of the
85 number of classes taught or of the number of students scoring a
86 4 or higher on the international baccalaureate examination.

88 Bonuses awarded to a teacher according to this paragraph shall
89 not exceed $2,000, except that the bonuses awarded to a teacher
90 in a school designated with a grade of “D” or “F” shall not
91 exceed $5,000, in any given school year and shall be in addition
92 to any regular wage or other bonus the teacher received or is
93 scheduled to receive. If funds received pursuant to this
94 paragraph are not sufficient to fully pay for teacher bonuses
95 after paying mandatory program and examination fees, a school
96 district may prorate all teacher bonuses proportionately to the
97 total funds available.
98 (n) Calculation of additional full-time equivalent
99 membership based on Advanced International Certificate of
100 Education examination scores of students.—A value of 0.16 full
101 time equivalent student membership shall be calculated for each
102 student enrolled in a full-credit Advanced International
103 Certificate of Education course who receives a score of E or
104 higher on a subject examination. A value of 0.08 full-time
105 equivalent student membership shall be calculated for each
106 student enrolled in a half-credit Advanced International
107 Certificate of Education course who receives a score of E or
108 higher on a subject examination. A value of 0.3 full-time
109 equivalent student membership shall be calculated for each
110 student who receives an Advanced International Certificate of
111 Education diploma. Such value shall be added to the total full
112 time equivalent student membership in basic programs for grades
113 9 through 12 in the subsequent fiscal year. Each school district
114 shall allocate 100 percent of the funds received for Advanced
115 International Certificate of Education instruction to the school
116 whose students generate such funds and within that school
117 program that generates such funds. Funds allocated in accordance
118 with this paragraph shall be expended solely for the payment of
119 allowable costs associated with the Advanced International
120 Certificate of Education program and teacher bonuses. Such
121 allowable costs are only those associated with Advanced
122 International Certificate of Education annual school fees;
123 Advanced International Certificate of Education examination
124 fees; salaries and benefits for school-based Advanced
125 International Certificate of Education coordinators;
126 supplemental books, instructional supplies, instructional
127 equipment, or instructional materials for Advanced International
128 Certificate of Education courses; programs or activities that
129 identify prospective Advanced International Certificate of
130 Education students or prepare prospective students to enroll in
131 Advanced International Certificate of Education courses; and
132 training or professional development for Advanced International
133 Certificate of Education teachers. The teacher bonus shall equal
134 the proportionate value of the 0.16 or 0.08 additional funding
135 per eligible student score minus allowable costs, or $50 per
136 eligible student score, whichever is greater. The teacher bonus
137 in a school designated with a grade of “D” or “F” shall be an
138 additional $500 if any one of the teacher’s Advanced
139 International Certificate of Education students scores E or
140 higher on an Advanced International Certificate of Education
141 examination. The school district shall distribute to each
142 classroom teacher who provided Advanced International
143 Certificate of Education instruction:
144 1. A bonus in the amount of $50 for each student taught by
145 the Advanced International Certificate of Education teacher in
146 each full-credit Advanced International Certificate of Education
147 course who receives a score of E or higher on the Advanced
148 International Certificate of Education examination. A bonus in
149 the amount of $25 for each student taught by the Advanced
150 International Certificate of Education teacher in each half
151 credit Advanced International Certificate of Education course
152 who receives a score of E or higher on the Advanced
153 International Certificate of Education examination.
154 2. An additional bonus of $500 to each Advanced
155 International Certificate of Education teacher in a school
156 designated with a grade of “D” or “F” who has at least one
157 student scoring E or higher on the full-credit Advanced
158 International Certificate of Education examination, regardless
159 of the number of classes taught or of the number of students
160 scoring an E or higher on the full-credit Advanced International
161 Certificate of Education examination.
162 3. Additional bonuses of $250 each to teachers of half
163 credit Advanced International Certificate of Education classes
164 in a school designated with a grade of “D” or “F” which has at
165 least one student scoring an E or higher on the half-credit
166 Advanced International Certificate of Education examination in
167 that class. The maximum additional bonus for a teacher awarded
168 in accordance with this subparagraph shall not exceed $500 in
169 any given school year. Teachers receiving an award under
170 subparagraph 2. are not eligible for a bonus under this
171 subparagraph.

173 Bonuses awarded to a teacher according to this paragraph shall
174 not exceed $2,000, except that the bonuses awarded to a teacher
175 in a school designated with a grade of “D” or “F” shall not
176 exceed $5,000, in any given school year and shall be in addition
177 to any regular wage or other bonus the teacher received or is
178 scheduled to receive. If funds received pursuant to this
179 paragraph are not sufficient to fully pay for teacher bonuses, a
180 school district may prorate all teacher bonuses proportionately
181 to the total funds available.
182 (o) Calculation of additional full-time equivalent
183 membership based on college board advanced placement scores of
184 students.—A value of 0.16 full-time equivalent student
185 membership shall be calculated for each student enrolled in each
186 advanced placement course who receives a score of 3 or higher on
187 the College Board Advanced Placement Examination for the prior
188 year and added to the total full-time equivalent student
189 membership in basic programs for grades 9 through 12 in the
190 subsequent fiscal year. Each school district shall allocate 100
191 percent of the funds received for Advanced Placement instruction
192 to the school that generates such funds. Funds allocated in
193 accordance with this paragraph shall be expended solely for the
194 payment of allowable costs associated with the Advanced
195 Placement Program and teacher bonuses. Such allowable costs are
196 only those associated with Advanced Placement examination fees;
197 salaries and benefits for school-based Advanced Placement
198 coordinators; supplemental books, instructional supplies,
199 instructional equipment, or instructional materials for Advanced
200 Placement courses; programs or activities that identify
201 prospective Advanced Placement students or prepare prospective
202 students to enroll in Advanced Placement courses; and training
203 or professional development for Advanced Placement teachers. The
204 teacher bonus shall equal the proportionate value of the 0.16
205 additional funding per eligible student score minus allowable
206 costs, or $50 per eligible student score, whichever is greater.
207 The teacher bonus in a school designated with a grade of “D” or
208 “F” shall include an additional $500 per student for the
209 teacher’s first four students who score 3 or higher on an
210 Advanced Placement examination. Each district must allocate at
211 least 80 percent of the funds provided to the district for
212 advanced placement instruction, in accordance with this
213 paragraph, to the high school that generates the funds. The
214 school district shall distribute to each classroom teacher who
215 provided advanced placement instruction:
216 1. A bonus in the amount of $50 for each student taught by
217 the Advanced Placement teacher in each advanced placement course
218 who receives a score of 3 or higher on the College Board
219 Advanced Placement Examination.
220 2. An additional bonus of $500 to each Advanced Placement
221 teacher in a school designated with a grade of “D” or “F” who
222 has at least one student scoring 3 or higher on the College
223 Board Advanced Placement Examination, regardless of the number
224 of classes taught or of the number of students scoring a 3 or
225 higher on the College Board Advanced Placement Examination.

227 Bonuses awarded to a teacher according to this paragraph shall
228 not exceed $2,000, except that the bonuses awarded to a teacher
229 in a school designated with a grade of “D” or “F” shall not
230 exceed $5,000, in any given school year and shall be in addition
231 to any regular wage or other bonus the teacher received or is
232 scheduled to receive. If funds received pursuant to this
233 paragraph are not sufficient to fully pay for teacher bonuses, a
234 school district may prorate all teacher bonuses proportionately
235 to the total funds available.
236 Section 3. Paragraph (l) is added to subsection (6) of
237 section 1007.35, Florida Statutes, to read:
238 1007.35 Florida Partnership for Minority and
239 Underrepresented Student Achievement.—
240 (6) The partnership shall:
241 (l) In cooperation with the Department of Education, post
242 an annual report on the department’s website on or before
243 January 15 of each year which delineates:
244 1. The total number of teachers who participate in
245 professional development associated with Advanced Placement
246 courses, the registration fees associated with such professional
247 development, and the number and value of scholarships awarded by
248 the College Board for teacher participation in Advanced
249 Placement professional development.
250 2. The number of students per school who enroll in Advanced
251 Placement courses, the number of Advanced Placement courses in
252 which such students enroll, the number and percentage of
253 students enrolled in such courses who take the Advanced
254 Placement examination that corresponds to each course, the
255 number and percentage of students enrolled in Advanced Placement
256 courses who take the Advanced Placement examination that
257 corresponds to each course and receive a score of 3 or higher,
258 and the number and percentage of students who take an Advanced
259 Placement examination without having enrolled in the
260 corresponding Advanced Placement course and earn a score of 3 or
261 higher. Such information shall be reported at the state level by
262 subject, race, and gender.
263 3. The amount paid by the state for each examination and
264 the total rebates provided to each school for the administration
265 of the College Board Advanced Placement Examination.
266 Section 4. This act shall take effect July 1, 2010.
