Florida Senate - 2010 SB 1982 By Senator Aronberg 27-01047-10 20101982__ 1 A bill to be entitled 2 An act relating to the jamming of electronic speed 3 measuring devices; creating s. 316.1907, F.S.; 4 prohibiting a vehicle from being equipped with any 5 device that is designed for, or is capable of, 6 jamming, scrambling, disabling, or otherwise 7 interfering with a radar, laser, or any other 8 electronic device used by a law enforcement agency to 9 measure the speed of a moving vehicle; prohibiting a 10 person from using, buying, possessing, manufacturing, 11 selling, or otherwise distributing such a jamming 12 device; providing an exception for a law enforcement 13 officer acting in his or her official capacity; 14 authorizing a law enforcement officer to seize such a 15 jamming device; providing a penalty; providing an 16 effective date. 17 18 Be It Enacted by the Legislature of the State of Florida: 19 20 Section 1. Section 316.1907, Florida Statutes, is created 21 to read: 22 316.1907 Jamming of electronic speed-measuring devices.— 23 (1)(a) A vehicle may not be equipped with any device that 24 is designed for, or is capable of, jamming, scrambling, 25 neutralizing, disabling, or otherwise interfering with a radar, 26 laser, or any other electronic device used by a law enforcement 27 agency to measure the speed of a moving vehicle. 28 (b) A person may not use, buy, possess, manufacture, sell, 29 or otherwise distribute any device that is designed for jamming, 30 scrambling, neutralizing, disabling, or otherwise interfering 31 with a radar, laser, or any other electronic device used by a 32 law enforcement agency to measure the speed of a moving vehicle. 33 (c) This subsection does not apply to a law enforcement 34 officer acting in his or her official capacity. 35 (2) A law enforcement officer may seize any device used in 36 violation of this section, which may be confiscated and 37 destroyed by order of the court. 38 (3) A person who violates this section shall be cited for a 39 noncriminal traffic infraction, punishable as provided in s. 40 318.14. 41 Section 2. This act shall take effect October 1, 2010.
