    2         An act relating to review of the presumptive parole
    3         release date for certain inmates; amending s. 947.174,
    4         F.S.; requiring a hearing examiner to review the
    5         presumptive parole release date of certain inmates
    6         every 7 years rather than every 5 years; providing an
    7         effective date.

    9  Be It Enacted by the Legislature of the State of Florida:
   10  
   11         Section 1. Paragraph (b) of subsection (1) of section
   12  947.174, Florida Statutes, is amended to read:
   13         947.174 Subsequent interviews.—
   14         (1)
   15         (b) For any inmate convicted of murder, attempted murder,
   16  sexual battery, or attempted sexual battery, or any inmate who
   17  has been sentenced to a 25-year minimum mandatory sentence
   18  previously provided in s. 775.082, and whose presumptive parole
   19  release date is more than 7 5 years after the date of the
   20  initial interview, a hearing examiner shall schedule an
   21  interview for review of the presumptive parole release date. The
   22  Such interview shall take place once within 7 5 years after the
   23  initial interview and once every 7 5 years thereafter if the
   24  commission finds that it is not reasonable to expect that parole
   25  will be granted at a hearing during the following years and
   26  states the bases for the finding in writing. For any inmate who
   27  is within 7 years of his or her tentative release date, the
   28  commission may establish an interview date before prior to the
   29  7-year 5-year schedule.
   30         Section 2. This act shall take effect July 1, 2010.
