Florida Senate - 2010 SB 2002 By Senator Lynn 7-01253-10 20102002__ 1 A bill to be entitled 2 An act relating to behavioral health services; 3 amending s. 394.9082, F.S.; exempting certain 4 providers from participating in a community-based 5 managing entity for purposes of providing mental 6 health services or substance abuse prevention and 7 treatment services; providing an effective date. 8 9 Be It Enacted by the Legislature of the State of Florida: 10 11 Section 1. Paragraph (a) of subsection (4) of section 12 394.9082, Florida Statutes, is amended to read: 13 394.9082 Behavioral health managing entities.— 14 (4) CONTRACT FOR SERVICES.— 15 (a) The department may contract for the purchase and 16 management of behavioral health services with community-based 17 managing entities. The department may require a managing entity 18 to contract for specialized services that are not currently part 19 of the managing entity’s network if the department determines 20 that itto do sois in the best interests of consumers of 21 services. The secretary shall determine the schedule for phasing 22 in contracts with managing entities. The managing entities 23 shall, at a minimum, be accountable for the operational 24 oversight of the delivery of behavioral health services funded 25 by the department and for the collection and submission of the 26 required data pertaining to these contracted services. A 27 managing entity shall serve a geographic area designated by the 28 department. The geographic area must havebe ofsufficientsize29inpopulation andhaveenough public funds for behavioral health 30 services to allow for flexibility and maximum efficiency. 31 Providers within a judicial circuit or other designated 32 geographic area which demonstrate the capacity to fulfill the 33 goals and essential elements set forth in subsections (5) and 34 (6) are exempt from participating in and providing services 35 through a managing entity. 36 Section 2. This act shall take effect July 1, 2010.
