Florida Senate - 2010 SB 2406 By Senator Bennett 21-01999-10 20102406__ 1 A bill to be entitled 2 An act relating to trust funds; creating the 3 Sustainable and Renewable Energy Policy Trust Fund 4 within the Florida Energy Office; specifying the 5 purpose of the trust fund; providing a funding source 6 for the trust fund; providing for the balance in the 7 trust fund to be carried forward each year; providing 8 for the future review and termination or re-creation 9 of the trust fund; providing a contingent effective 10 date. 11 12 Be It Enacted by the Legislature of the State of Florida: 13 14 Section 1. (1) The Sustainable and Renewable Energy Policy 15 Trust Fund is created within the Florida Energy Office. The 16 trust fund shall be administered by the head of the office or 17 his or her designee. Funds allocated to the trust fund include 18 funds received from state appropriations, federal and state 19 grants, and deposits consisting of the monthly service charge 20 collected by the electric utilities in the state from every 21 residential, commercial, and industrial consumer of electric 22 service. The funds in the trust fund shall be used to support 23 the activities of the direct-support organization of the office 24 relating to sustainable and renewable energy projects in this 25 state. 26 (2) Notwithstanding s. 216.301, Florida Statutes, and 27 pursuant to s. 216.351, Florida Statutes, any balance in the 28 trust fund at the end of any fiscal year shall remain in the 29 trust fund and be available for carrying out the purposes of the 30 trust fund. 31 (3) In accordance with s. 19(f)(2), Article III of the 32 State Constitution, the Sustainable and Renewable Energy Policy 33 Trust Fund shall, unless terminated sooner, be terminated on 34 July 1, 2014. Before its scheduled termination, the trust fund 35 shall be reviewed as provided in s. 215.3206(1) and (2), Florida 36 Statutes. 37 Section 2. This act shall take effect on the same date that 38 Senate Bill ___ or similar legislation takes effect, if such 39 legislation is adopted in the same legislative session, or an 40 extension thereof, and becomes law, but this act shall not take 41 effect unless it is enacted by a three-fifths vote of the 42 membership of each house of the Legislature.
