Florida Senate - 2010 SB 2542 By Senator Crist 12-01361-10 20102542__ 1 A bill to be entitled 2 An act relating to correctional probation officers; 3 amending s. 112.181, F.S.; revising the definition of 4 the term “emergency rescue or public safety worker” to 5 include correctional probation officers in provisions 6 relating to certain communicable diseases suffered in 7 the line of duty; amending s. 112.19, F.S.; revising 8 provisions relating to death benefits to include 9 correctional probation officers; providing an 10 effective date. 11 12 Be It Enacted by the Legislature of the State of Florida: 13 14 Section 1. Paragraph (b) of subsection (1) of section 15 112.181, Florida Statutes, is amended to read: 16 112.181 Firefighters, paramedics, emergency medical 17 technicians, law enforcement officers, correctional probation 18 officer, correctional officers; special provisions relative to 19 certain communicable diseases.— 20 (1) DEFINITIONS.—As used in this section, the term: 21 (b) “Emergency rescue or public safety worker” means any 22 person employed full time by the state or any political 23 subdivision of the state as a firefighter, paramedic, emergency 24 medical technician, law enforcement officer, correctional 25 probation officer, or correctional officer who, in the course of 26 employment, runs a high risk of occupational exposure to 27 hepatitis, meningococcal meningitis, or tuberculosis and who is 28 not employed elsewhere in a similar capacity. However, the term 29 “emergency rescue or public safety worker” does not include any 30 person employed by a public hospital licensed under chapter 395 31 or any person employed by a subsidiary thereof. 32 Section 2. Paragraph (g) of subsection (2) of section 33 112.19, Florida Statutes, is amended to read: 34 112.19 Law enforcement, correctional, and correctional 35 probation officers; death benefits.— 36 (2) 37 (g) Any political subdivision of the state that employs a 38 full-time law enforcement officer as defined in s. 943.10(1),or39 a full-time correctional officer as defined in s. 943.10(2), or 40 a full-time correctional probation officer as defined in s. 41 943.10(3) who is killed in the line of duty on or after July 1, 42 1993, as a result of an act of violence inflicted by another 43 person while the officer is engaged in the performance of law 44 enforcement duties or as a result of an assault against the 45 officer under riot conditions shall pay the entire premium of 46 the political subdivision’s health insurance plan for the 47 employee’s surviving spouse until remarried, and for each 48 dependent child of the employee until the child reaches the age 49 of majority or until the end of the calendar year in which the 50 child reaches the age of 25 if: 51 1. At the time of the employee’s death, the child is 52 dependent upon the employee for support; and 53 2. The surviving child continues to be dependent for 54 support, or the surviving child is a full-time or part-time 55 student and is dependent for support. 56 Section 3. This act shall take effect July 1, 2010.
