Florida Senate - 2010 SB 2652 By Senator Fasano 11-01365A-10 20102652__ 1 A bill to be entitled 2 An act relating to motor vehicle licenses; amending s. 3 320.02, F.S.; providing for a voluntary checkoff on 4 motor vehicle registration applications to permit 5 contributions to Ronald McDonald House; amending s. 6 322.08, F.S.; providing for a voluntary checkoff on 7 driver’s license applications to permit contributions 8 to Ronald McDonald House; providing that such 9 contributions are not considered income of a revenue 10 nature for purposes of a service charge; providing an 11 effective date. 12 13 Be It Enacted by the Legislature of the State of Florida: 14 15 Section 1. Paragraph (i) is added to subsection (15) of 16 section 320.02, Florida Statutes, to read: 17 320.02 Registration required; application for registration; 18 forms.— 19 (15) 20 (i) The application form for motor vehicle registration and 21 renewal of registration must include language permitting a 22 voluntary contribution of $1 to Ronald McDonald House. Such 23 contributions must be transferred by the department each month 24 to Ronald McDonald House Charities of Tampa Bay, Inc. 25 26 For the purpose of applying the service charge provided in s. 27 215.20, contributions received under this subsection are not 28 income of a revenue nature. 29 Section 2. Subsection (7) of section 322.08, Florida 30 Statutes, is amended to read: 31 322.08 Application for license.— 32 (7) The application form for a driver’s license or 33 duplicate thereof shall include language permitting the 34 following: 35 (a) A voluntary contribution of $1 per applicant, which 36 contribution shall be deposited into the Health Care Trust Fund 37 for organ and tissue donor education and for maintaining the 38 organ and tissue donor registry. 39 (b) A voluntary contribution of $1 per applicant, which 40 contribution shall be distributed to the Florida Council of the 41 Blind. 42 (c) A voluntary contribution of $2 per applicant, which 43 shall be distributed to the Hearing Research Institute, 44 Incorporated. 45 (d) A voluntary contribution of $1 per applicant, which 46 shall be distributed to the Juvenile Diabetes Foundation 47 International. 48 (e) A voluntary contribution of $1 per applicant, which 49 shall be distributed to the Children’s Hearing Help Fund. 50 (f) A voluntary contribution of $1 per applicant, which 51 shall be distributed to Family First, a nonprofit organization. 52 (g) A voluntary contribution of $1 per applicant, to Stop 53 Heart Disease, which shall be distributed to the Florida Heart 54 Research Institute, a nonprofit organization. 55 (h) A voluntary contribution of $1 to Ronald McDonald 56 House. Such contributions must be transferred by the department 57 each month to Ronald McDonald House Charities of Tampa Bay, Inc. 58 59 A statement providing an explanation of the purpose of the trust 60 funds shall also be included. For the purpose of applying the 61 service charge provided in s. 215.20, contributions received 62 under paragraphs (b), (c), (d), (e), (f),and(g), and (h) and 63 under s. 322.18(9) are not income of a revenue nature. 64 Section 3. This act shall take effect July 1, 2010.
