Florida Senate - 2010 SJR 2706 By Senators Richter, Gardiner, Altman, Baker, Gaetz, Bennett, Storms, Negron, and Fasano 37-00286A-10 20102706__ 1 Senate Joint Resolution 2 A joint resolution proposing an amendment to Section 6 3 of Article I of the State Constitution to require a 4 direct and secret vote when designating or authorizing 5 employee representation by a labor organization. 6 7 Be It Resolved by the Legislature of the State of Florida: 8 9 That the following amendment to Section 6 of Article I of 10 the State Constitution is agreed to and shall be submitted to 11 the electors of this state for approval or rejection at the next 12 general election or at an earlier special election specifically 13 authorized by law for that purpose: 14 ARTICLE I 15 DECLARATION OF RIGHTS 16 Section 6. Right to work.—The right of persons to work 17 shall not be denied or abridged on account of membership or non 18 membership in any labor union or labor organization. The right 19 of employees, by and through a labor organization, to bargain 20 collectively shall not be denied or abridged. Public employees 21 shall not have the right to strike. To guarantee an individual’s 22 right to be free from intimidation or coercion, any designation 23 or authorization of employee representation by a labor 24 organization shall be by direct and secret vote. 25 BE IT FURTHER RESOLVED that the following statement be 26 placed on the ballot: 27 CONSTITUTIONAL AMENDMENT 28 ARTICLE I, SECTION 6 29 DIRECT AND SECRET VOTE ON EMPLOYEE REPRESENTATION BY A 30 LABOR ORGANIZATION.—Proposing an amendment to the State 31 Constitution to guarantee an individual’s right to be free from 32 intimidation or coercion by requiring a direct and secret vote 33 when designating or authorizing employee representation by a 34 labor organization.
