Florida Senate - 2010 SB 2716 By Senator Aronberg 27-01801B-10 20102716__ 1 A bill to be entitled 2 An act relating to the outsourcing of services and 3 activities by the state; amending s. 287.0574, F.S.; 4 requiring a contract for a proposed outsourcing by the 5 state to prohibit a contractor from authorizing an 6 automatic increase in the salaries or benefits of its 7 employees; requiring a contract for a proposed 8 outsourcing by the state to require the contractor to 9 submit a written request to an agency for an increase 10 in certain employees’ salaries or benefits; requiring 11 a contract for a proposed outsourcing by the state to 12 require the state agency to inform the contractor of 13 the reasons that justify the approval of increases in 14 the salaries or benefits of the contractor’s employees 15 under certain conditions; requiring that the Office of 16 Program Policy Analysis and Government Accountability 17 submit a report to the Legislature regarding increases 18 in salaries and benefits for contract employees; 19 providing an effective date. 20 21 Be It Enacted by the Legislature of the State of Florida: 22 23 Section 1. Paragraph (m) is added to subsection (5) of 24 section 287.0574, Florida Statutes, to read: 25 287.0574 Business cases to outsource; review and analysis; 26 requirements.— 27 (5) In addition to the contract requirements provided in s. 28 287.058, each contract for a proposed outsourcing, pursuant to 29 this section, must include, but need not be limited to, the 30 following contractual provisions: 31 (m) A provision that: 32 1. Prohibits the contractor from authorizing an automatic 33 increase in the salary or benefit of a contractor’s employee who 34 is providing an activity or service under the contract. 35 2. Requires the contractor to submit a written request to 36 the agency for an increase in the salary or benefit of a 37 contractor’s employee. 38 3. If the agency approves any increase in a salary or 39 benefit, requires the agency to inform the contractor of the 40 reasons that justify the approval of any increase, including the 41 employee’s original base salary and the percentage of the 42 approved increase. 43 44 By July 1, 2011, the Office of Program Policy Analysis and 45 Government Accountability shall submit a report to the President 46 of the Senate and the Speaker of the House of Representatives 47 which contains the total number of requests by the contractors 48 for employees’ salaries and benefits to be increased, the number 49 of requests that were approved, the percentage increase of each 50 approved request, and the reasons for granting approval. 51 Section 2. This act shall take effect July 1, 2010.
