    1                        A bill to be entitled                      
    2         An act relating to career offenders; amending s.
    3         775.261, F.S.; providing that it is a first-degree
    4         misdemeanor for a person to perform specified acts
    5         with the intent to assist a career offender in eluding
    6         a law enforcement agency that is seeking to find the
    7         career offender to question the career offender about,
    8         or to arrest the career offender for, his or her
    9         noncompliance; providing criminal penalties; providing
   10         an effective date.

   12  Be It Enacted by the Legislature of the State of Florida:
   13  
   14         Section 1. Subsection (10) is added to section 775.261,
   15  Florida Statutes, to read:
   16         775.261 The Florida Career Offender Registration Act.—
   17         (10)ASSISTING IN NONCOMPLIANCE.—It is a misdemeanor of the
   18  first degree, punishable as provided in s. 775.082 or s.
   19  775.083, for a person who has reason to believe that a career
   20  offender is not complying, or has not complied, with the
   21  requirements of this section and who, with the intent to assist
   22  the career offender in eluding a law enforcement agency that is
   23  seeking to find the career offender to question the career
   24  offender about, or to arrest the career offender for, his or her
   25  noncompliance with the requirements of this section, to:
   26         (a)Withhold information from, or fail to notify, the law
   27  enforcement agency about the career offender’s noncompliance
   28  with the requirements of this section and, if known, the
   29  whereabouts of the career offender;
   30         (b)Harbor or attempt to harbor, or assist another in
   31  harboring or attempting to harbor, the career offender;
   32         (c)Conceal or attempt to conceal, or assist another in
   33  concealing or attempting to conceal, the career offender; or
   34         (d)Provide information to the law enforcement agency
   35  regarding the career offender which the person knows to be
   36  false.
   37         Section 2. This act shall take effect July 1, 2010.
