    1                        A bill to be entitled                      
    2         An act relating to the East Lake Tarpon Community,
    3         Pinellas County; providing requirements for the
    4         municipal annexation of the East Lake Tarpon
    5         Community; requiring a referendum of the electors
    6         within the community prior to such annexation;
    7         describing the community boundaries; clarifying that
    8         the act does not prohibit voluntary annexation;
    9         providing an effective date.

   11         WHEREAS, the East Lake Tarpon Community is an area
   12  surrounded on three sides by a lake and the county lines of
   13  Pasco and Hillsborough Counties, situated in the northeastern
   14  area of unincorporated Pinellas County, and
   15         WHEREAS, East Lake Tarpon was developed as a predominantly
   16  residential community, with most of the residents residing
   17  within the deed-restricted communities of the East Lake Tarpon
   18  area, and
   19         WHEREAS, the residents of East Lake Tarpon are developing a
   20  common vision of East Lake Tarpon’s future as a family oriented,
   21  residential, scenic community where small businesses and
   22  commercial uses serve to complement and support area residents,
   23  and the community is working with Pinellas County to adopt an
   24  East Lake Tarpon Community Overlay within the Pinellas County
   25  Comprehensive Plan that reflects the community’s vision, and
   26         WHEREAS, the residents of the East Lake Tarpon Community
   27  pay ad valorem taxes to support and receive fire control
   28  services from the East Lake Tarpon Fire Control District, NOW,
   29  THEREFORE,

   31  Be It Enacted by the Legislature of the State of Florida:
   32  
   33         Section 1. Annexation of territory by municipalities;
   34  communitywide referendum required.—Notwithstanding any other
   35  provision of law, a municipality within Pinellas County may not
   36  annex any unincorporated territory situated within the defined
   37  boundaries of the East Lake Tarpon Community following the
   38  effective date of this act unless the annexation of all of the
   39  territory within the boundaries of the East Lake Tarpon
   40  Community is approved by a majority vote of the electors of the
   41  East Lake Tarpon Community voting in a referendum called for
   42  that purpose.
   43         Section 2. Legal description; East Lake Tarpon Community.
   44  All those lands situate, lying, and being within the herein
   45  described parcel:
   46  The East Lake Tarpon Community is described by the following:
   47         Begin at the Northeast Corner of Section 1, Township
   48         27 South, Range 16 East, Pinellas County, Florida;
   49         thence run south along the said East Section Line
   50         (Hillsborough/Pinellas County Line) to the East-West
   51         Half Section Line of Section 1, Township 28 South,
   52         Range 16 East; thence West along said Half Section
   53         Line to the Easterly right-of-way Line of Florida
   54         Power Corporation; thence South along said right-of
   55         way Line to the East-West Half Section Line of Section
   56         12, Township 28 South, Range 16 East; thence East
   57         along said Half Section Line to the Northeast Corner
   58         of Florida Power Corporation Substation; thence South
   59         along the East Line of said Substation to the South
   60         Section Line of said Section 12; thence East to the
   61         East Section Line of Section 13, Township 28 South,
   62         Range 16 East (Hillsborough/Pinellas County Line);
   63         thence South along said County Line to the South Line
   64         of the Northeast 1/4 of the Southeast 1/4 of said
   65         Section 13; thence West along said Line to the
   66         Westerly right-of-way Line of Florida Power

   89         right-of-way Line of Florida Power Corporation; thence

   92         line a distance of 1,837.78 feet; thence North to the
   93         South Line of the Northeast 1/4 of the Northwest 1/4
   94         of said Section 1; thence West along said line to the
   95         West Line of the Northeast 1/4 of the Northwest 1/4 of
   96         said Section 1; thence North along said line to the
   97         North Line of the Southwest 1/4 of the Southwest 1/4
   98         of Section 36, Township 27 South, Range 16 East;

  108         the North Line of said Section 15 to the North-South

  110         Centerline to the northerly right-of-way line of Tampa
  111         Road (S.R. 584); thence in a Northwesterly direction
  112         along said right-of-way line to the Southerly Line of
  113         Florida Power Corporation; thence Southwesterly along
  114         said Southerly Line to the centerline of the Lake
  115         Tarpon Outfall Canal; thence Northerly along the
  116         centerline of the Lake Tarpon Outfall Canal into Lake
  117         Tarpon to its North-South Centerline; thence Northerly
  118         along the North-South Centerline of Lake Tarpon to the
  119         City Limit Line of the City of Tarpon Springs on the
  120         Northern shoreline of Lake Tarpon; thence along the
  121         City Limit Line of Tarpon Springs around its Easterly
  122         point above Lake Tarpon and then Westerly to the
  123         North-South Centerline of Salt Lake; thence northerly
  124         along the North-South Centerline of Salt Lake to the
  125         Centerline of the Anclote River; thence Northeasterly
  126         along the Centerline of the Anclote River to the
  127         Pasco-Pinellas County Line; thence East along
  128         the Pasco/Pinellas County Line to the Point of
  129         Beginning.
  130         LESS any areas annexed into the corporate municipal
  131         limits of Oldsmar or Tarpon Springs.
  132         Section 3. Nothing in this act shall prohibit any voluntary
  133  annexation.
  134         Section 4. This act shall take effect upon becoming a law.
