    1                        A bill to be entitled                      
    2         An act relating to Pasco County; providing that any
    3         deed restrictions affecting real property located in
    4         the county which require persons in single-family
    5         homes to use specific solid waste collection services
    6         are void and unenforceable; providing exceptions;
    7         providing for the county commission to establish
    8         exclusive solid waste collection franchises; providing
    9         an effective date.

   11  Be It Enacted by the Legislature of the State of Florida:
   12  
   13         Section 1. (1) Notwithstanding any general or special act
   14  to the contrary, deed restrictions or other requirements
   15  affecting real property located in Pasco County which require
   16  persons in single-family homes to use specific solid waste
   17  collection services are void and unenforceable. Such residents
   18  may use any solid waste collection service that provides service
   19  to their location.
   20         (2) This act does not apply to any condominium or
   21  cooperative property regulated by chapter 718 or chapter 719,
   22  Florida Statutes, or to any property that is covered by a deed
   23  restriction or covenant that requires the property owner to join
   24  a mandatory homeowners’ association.
   25         (3) This act does not prevent the Pasco County Board of
   26  County Commissioners from establishing exclusive solid waste
   27  collection franchises.
   28         Section 2. This act shall take effect upon becoming a law.
