A bill to be entitled
2An act relating to specialty license plates; amending ss.
3320.08056 and 320.08058, F.S.; creating the Fraternal
4Order of Police license plate; establishing an annual use
5fee for the plate; providing for the distribution of use
6fees received from the sale of such plates; providing an
7effective date.

9Be It Enacted by the Legislature of the State of Florida:

11     Section 1.  Paragraph (rrr) is added to subsection (4) of
12section 320.08056, Florida Statutes, to read:
13     320.08056  Specialty license plates.--
14     (4)  The following license plate annual use fees shall be
15collected for the appropriate specialty license plates:
16     (rrr)  Fraternal Order of Police license plate, $25.
17     Section 2.  Subsection (70) is added to section 320.08058,
18Florida Statutes, to read:
19     320.08058  Specialty license plates.--
20     (70)  FRATERNAL ORDER OF POLICE LICENSE PLATES.--
21     (a)1.  The department shall develop a Fraternal Order of
22Police license plate as provided in this section. The plate must
23bear the colors and design approved by the department. The word
24"Florida" must appear at the top of the plate, and the words
25"Fraternal Order of Police" must appear at the bottom of the
26plate.
27     2.  The department may issue the plate only to an applicant
28who submits a notarized letter from the Florida State Lodge of
29the Fraternal Order of Police stating that the applicant is a
30member of the lodge in good standing or a member of a lodge
31member's family, together with other fees and documents required
32for a specialty plate.
33     (b)  The annual use fees shall be distributed to the
34Florida State Lodge of the Fraternal Order of Police, which
35shall retain all proceeds until the startup costs to develop and
36establish the plate have been recovered. Thereafter, the
37proceeds shall be distributed to the Florida State Lodge
38Memorial Foundation of the Fraternal Order of Police and used as
39follows:
40     1.  A maximum of 25 percent of the proceeds may be used to
41promote and market the plate, to administer the license plate
42program, and to pay administrative costs directly associated
43with the state Fraternal Order of Police Law Enforcement
44Memorial.
45     2.  The remaining proceeds shall be used by the foundation
46to fund projects, programs, or events related to the memorial or
47to fund improvements, maintenance, or other support for the
48memorial.
49     Section 3.  This act shall take effect July 1, 2010.
