10 | Be It Enacted by the Legislature of the State of Florida: |
11 |
|
12 | Section 1. Paragraph (rrr) is added to subsection (4) of |
13 | section 320.08056, Florida Statutes, to read: |
14 | 320.08056 Specialty license plates.- |
15 | (4) The following license plate annual use fees shall be |
16 | collected for the appropriate specialty license plates: |
17 | (rrr) Fraternal Order of Police license plate, $25. |
18 | Section 2. Paragraph (b) of subsection (18) of section |
19 | 320.08058, Florida Statutes, is amended, and subsection (70) is |
20 | added to that section, to read: |
21 | 320.08058 Specialty license plates.- |
22 | (18) SEA TURTLE LICENSE PLATES.- |
23 | (b) The first $500,000 of annual use fees shall be |
24 | deposited in the Marine Resources Conservation Trust Fund in the |
25 | Fish and Wildlife Conservation Commission and shall be used by |
26 | the Florida Marine Turtle Protection Program to conduct sea |
27 | turtle protection, research, and recovery programs. The next |
28 | $215,000 in annual use fees shall be distributed to the |
29 | Caribbean Conservation Corporation to fund sea turtle research |
30 | and education programs. The Caribbean Conservation Corporation |
31 | shall annually distribute assigned funds through a Sea Turtle |
32 | Grants Program that supports sea turtle research and education |
33 | activities of Florida-based nonprofit groups, education and |
34 | research institutions, and coastal counties in this state. The |
35 | Caribbean Conservation Corporation shall write and publish |
36 | procedures for submitting grant applications and criteria for |
37 | allocating available funds, and shall appoint a technical |
38 | advisory committee, composed of at least five members, including |
39 | two representatives from the Fish and Wildlife Conservation |
40 | Commission, to establish funding priorities and select grant |
41 | recipients from proposals submitted by eligible entities. Two of |
42 | the members shall be selected from the Fish and Wildlife |
43 | Conservation Commission; one member shall be selected on a |
44 | rotating biennial basis from a county bordering on the Atlantic |
45 | Coast with sea turtle nesting sites; one member shall be |
46 | selected on a rotating biennial basis from a county bordering on |
47 | the Gulf Coast with sea turtle nesting sites; one member shall |
48 | be the executive director of the Caribbean Conservation |
49 | Corporation; and two members shall be selected at large. Any |
50 | additional annual revenue shall be distributed as follows: 70 |
51 | percent shall be deposited in the Marine Resources Conservation |
52 | Trust Fund and used by the Florida Marine Turtle Protection |
53 | Program for sea turtle conservation activities and 30 percent |
54 | shall be assigned to the Caribbean Conservation Corporation for |
55 | distribution through the Sea Turtle Grants Program. From the |
56 | funds distributed to the Caribbean Conservation Corporation, an |
57 | amount not to exceed 10 percent of the total annual revenue from |
58 | the sale of the plate may be used for marketing the Sea Turtle |
59 | license plate and for administrative costs directly associated |
60 | with the grants program. A maximum of 15 percent of the funds |
61 | distributed to the Caribbean Conservation Corporation may be |
62 | expended for administrative costs directly associated with the |
63 | grants program, and a maximum of 10 percent may be used to |
64 | promote and market the Sea Turtle license plate. Funds received |
65 | by the Caribbean Conservation Corporation from the Sea Turtle |
66 | license plate or the Sea Turtle Grants Program and funds |
67 | received by any grant recipient of the Sea Turtle Grants Program |
68 | may not be used for litigation. |
69 | (70) FRATERNAL ORDER OF POLICE LICENSE PLATES.- |
70 | (a)1. The department shall develop a Fraternal Order of |
71 | Police license plate as provided in this section. The plate must |
72 | bear the colors and design approved by the department. The word |
73 | "Florida" must appear at the top of the plate, and the words |
74 | "Fraternal Order of Police" must appear at the bottom of the |
75 | plate. |
76 | 2. The department may issue the plate only to an applicant |
77 | who submits a notarized letter from the Florida State Lodge of |
78 | the Fraternal Order of Police stating that the applicant is a |
79 | member of the lodge in good standing or a member of a lodge |
80 | member's family, together with other fees and documents required |
81 | for a specialty plate. |
82 | (b) The annual use fees shall be distributed to the |
83 | Florida State Lodge of the Fraternal Order of Police, which |
84 | shall retain all proceeds until the startup costs to develop and |
85 | establish the plate have been recovered. Thereafter, the |
86 | proceeds shall be distributed to the Florida State Lodge |
87 | Memorial Foundation of the Fraternal Order of Police and used as |
88 | follows: |
89 | 1. A maximum of 10 percent of the proceeds may be used to |
90 | promote and market the plate, to administer the license plate |
91 | program, and to pay administrative costs directly associated |
92 | with the state Fraternal Order of Police Law Enforcement |
93 | Memorial. |
94 | 2. The remaining proceeds shall be used by the foundation |
95 | to fund projects, programs, or events related to the memorial or |
96 | to fund improvements, maintenance, or other support for the |
97 | memorial. |
98 | Section 3. This act shall take effect July 1, 2010. |
