A bill to be entitled
2An act relating to specialty license plates; amending ss.
3320.08056 and 320.08058, F.S.; revising authorized uses of
4revenue received from the sale of the Sea Turtle license
5plate; creating the Fraternal Order of Police license
6plate; establishing an annual use fee for the plate;
7providing for the distribution of use fees received from
8the sale of such plates; providing an effective date.

10Be It Enacted by the Legislature of the State of Florida:
11
12     Section 1.  Paragraph (rrr) is added to subsection (4) of
13section 320.08056, Florida Statutes, to read:
14     320.08056  Specialty license plates.-
15     (4)  The following license plate annual use fees shall be
16collected for the appropriate specialty license plates:
17     (rrr)  Fraternal Order of Police license plate, $25.
18Section 2.  Paragraph (b) of subsection (18) of section
19320.08058, Florida Statutes, is amended, and subsection (70) is
20added to that section, to read:
21     320.08058  Specialty license plates.-
22(18)  SEA TURTLE LICENSE PLATES.-
23     (b)  The first $500,000 of annual use fees shall be
24deposited in the Marine Resources Conservation Trust Fund in the
25Fish and Wildlife Conservation Commission and shall be used by
26the Florida Marine Turtle Protection Program to conduct sea
27turtle protection, research, and recovery programs. The next
28$215,000 in annual use fees shall be distributed to the
29Caribbean Conservation Corporation to fund sea turtle research
30and education programs. The Caribbean Conservation Corporation
31shall annually distribute assigned funds through a Sea Turtle
32Grants Program that supports sea turtle research and education
33activities of Florida-based nonprofit groups, education and
34research institutions, and coastal counties in this state. The
35Caribbean Conservation Corporation shall write and publish
36procedures for submitting grant applications and criteria for
37allocating available funds, and shall appoint a technical
38advisory committee, composed of at least five members, including
39two representatives from the Fish and Wildlife Conservation
40Commission, to establish funding priorities and select grant
41recipients from proposals submitted by eligible entities. Two of
42the members shall be selected from the Fish and Wildlife
43Conservation Commission; one member shall be selected on a
44rotating biennial basis from a county bordering on the Atlantic
45Coast with sea turtle nesting sites; one member shall be
46selected on a rotating biennial basis from a county bordering on
47the Gulf Coast with sea turtle nesting sites; one member shall
48be the executive director of the Caribbean Conservation
49Corporation; and two members shall be selected at large. Any
50additional annual revenue shall be distributed as follows: 70
51percent shall be deposited in the Marine Resources Conservation
52Trust Fund and used by the Florida Marine Turtle Protection
53Program for sea turtle conservation activities and 30 percent
54shall be assigned to the Caribbean Conservation Corporation for
55distribution through the Sea Turtle Grants Program. From the
56funds distributed to the Caribbean Conservation Corporation, an
57amount not to exceed 10 percent of the total annual revenue from
58the sale of the plate may be used for marketing the Sea Turtle
59license plate and for administrative costs directly associated
60with the grants program. A maximum of 15 percent of the funds
61distributed to the Caribbean Conservation Corporation may be
62expended for administrative costs directly associated with the
63grants program, and a maximum of 10 percent may be used to
64promote and market the Sea Turtle license plate. Funds received
65by the Caribbean Conservation Corporation from the Sea Turtle
66license plate or the Sea Turtle Grants Program and funds
67received by any grant recipient of the Sea Turtle Grants Program
68may not be used for litigation.
69     (70)  FRATERNAL ORDER OF POLICE LICENSE PLATES.-
70     (a)1.  The department shall develop a Fraternal Order of
71Police license plate as provided in this section. The plate must
72bear the colors and design approved by the department. The word
73"Florida" must appear at the top of the plate, and the words
74"Fraternal Order of Police" must appear at the bottom of the
75plate.
76     2.  The department may issue the plate only to an applicant
77who submits a notarized letter from the Florida State Lodge of
78the Fraternal Order of Police stating that the applicant is a
79member of the lodge in good standing or a member of a lodge
80member's family, together with other fees and documents required
81for a specialty plate.
82     (b)  The annual use fees shall be distributed to the
83Florida State Lodge of the Fraternal Order of Police, which
84shall retain all proceeds until the startup costs to develop and
85establish the plate have been recovered. Thereafter, the
86proceeds shall be distributed to the Florida State Lodge
87Memorial Foundation of the Fraternal Order of Police and used as
88follows:
89     1.  A maximum of 10 percent of the proceeds may be used to
90promote and market the plate, to administer the license plate
91program, and to pay administrative costs directly associated
92with the state Fraternal Order of Police Law Enforcement
93Memorial.
94     2.  The remaining proceeds shall be used by the foundation
95to fund projects, programs, or events related to the memorial or
96to fund improvements, maintenance, or other support for the
97memorial.
98     Section 3.  This act shall take effect July 1, 2010.
